Roadmap · stage 12 of 12

Renewal, permanent residence, citizenship

Renewal deadlines and fees for each basis, a new TIE, larga duración after five years and the path to citizenship by residence.

This stage was prepared by the ReloVictory team from primary sources; it has not yet been checked by a lawyer, and each item is marked with the date it was verified.

In brief

  • General regime: file 2 months before expiry or within 3 months after (with a fine of up to €500)
  • Renewal of temporary residence: fee €16.40 with modelo 790-052; new TIE €19.30 with 790-012
  • Larga duración: 5 years of continuous residence; absences of up to 6 months in a row and up to 10 months in total
  • Citizenship: 10 years of residence (1 year if married to a Spanish citizen), DELE A2 and CCSE, decision within a year
Edit profile

Step 236

How do you find your residence permit expiry date, and when should you set a renewal reminder?

The permit’s validity is stated in the authority’s decision and on the TIE card; the window for a general regime renewal opens two months before that date (article 64.1 of RD 1155/2024) [1].

Step 237

When do you file a general regime residence permit renewal?

A general regime renewal (no lucrativa, work, family reunification) is filed in the two months before the permit expires; filing on time keeps it valid until the decision (articles 64.1, 71.1, 80.1, 86.1 of RD 1155/2024) [1]. The application is also accepted within three months after expiry, but a fine of up to €500 is possible (articles 52.b and 55 of LO 4/2000) [2]. With electronic filing, fee 790-052 is paid at the moment of filing (article 2.3 of Orden PJC/617/2025) [3].

Step 238

What if your renewal is more than 3 months late?

If more than three months have passed since the permit expired, it can no longer be renewed under the general regime: the regulation allows renewal only for the holder of a valid permit or within three months of expiry (article 64.2.a of RD 1155/2024) [1]. Your stay becomes irregular, which is not a minor offence under article 52.b but a more serious one (article 53.1.a of LO 4/2000) [2]. Your case needs reviewing: SOJ ICAB gives free guidance [3], and so does SAIER for people living in Barcelona [4].

Step 239

What are the conditions for renewing no lucrativa?

To renew no lucrativa, you must have lived in Spain for more than 183 days in the calendar year, have funds for the new term and a seguro de enfermedad, enrol your children in school and pay the fee (article 64.2 of RD 1155/2024) [1]. The decision comes within three months, and silence means approval; the permit is renewed for two years, then the TIE within a month (article 64.7-64.9) [1]. With electronic filing, fee 790-052 is paid at the moment of filing (article 2.3 of Orden PJC/617/2025) [2].

The worker pays 790-052 (section 2.2.3), and the employer pays €81.54 on 790-062 for the work permit (section 3.2.2); the decision takes three months, and silence means approval [2][3]. A prórroga of a study estancia is filed electronically, in person or through a representative, at the Oficina de Extranjería of the province where the estancia was issued: within the two months before it ends or the three months after; if there is no decision within a month, the application is deemed refused (article 55 RD 1155/2024) [1]. The extension lasts as long as the course, but no more than a year; up to two extensions are allowed for higher education and post-compulsory secondary education, and one in all other cases [1]. Frequently asked questions

When should you apply to renew a residence permit in Spain?
Under the general regime (no lucrativa, employment, family reunification), within the two months before the permit expires; filing extends its validity until the decision. You can also file within three months after it expires, but that is a minor offence with a fine of up to €500. A study estancia and permits under Ley 14/2013 have their own rules: for the DNV, applications are also accepted within 90 days after expiry.
What happens if you are more than three months late with your renewal?
The renewal window closes: the regulation allows renewal only for the holder of a valid permit or within three months after it expires. After that your stay becomes irregular, which is a serious offence under LO 4/2000. The map stops at this step: you need a case review with a lawyer, not a self-filed application.
How much does a residence permit renewal cost?
Renewing temporary residence under the general regime costs €16.40 on modelo 790 código 052 (Orden PJC/617/2025, section 2.2); for employment, the employer also pays €81.54 on 790-062. Extending a study estancia costs €17.49, and a new TIE after renewal €19.30 on 790-012. The order does not state the DNV renewal amount: check it on the UGE page. With electronic filing, the fee is paid when you file (article 2.3 of the order).
How do you count the five years for permanent residence (larga duración)?
You need five years of legal and continuous residence immediately before the application. Absences do not break the period if none lasts longer than six consecutive months and together they come to no more than ten months over five years; with trips for work the total can be up to eighteen months. You apply within the two months before your current permit expires; if you already meet the conditions, you do not need to wait for it to expire.
Which exams do you need for Spanish citizenship?
Two Instituto Cervantes exams: DELE at level A2 or higher, and CCSE (knowledge of the Constitution and society). CCSE registration costs €85 and gives you two attempts; DELE A2 in Spain costs €138 according to the Instituto Cervantes price table for 2026. The citizenship application is filed electronically through the Ministry of Justice sede, with a fee of €104.05 on 790-026; the decision takes up to a year, and silence means refusal.
