- Application window: two months before expiry and three months after (for no lucrativa, employment and self-employment, family reunification and arraigo); applying within this period extends the validity of the previous authorisation until a decision is made [1].
- The decision is made within three months, and silence means approval for no lucrativa, employment, self-employment and family reunification (articles 64, 80, 87 and 71 respectively) [1]. For the DNV and other Ley 14/2013 permits, article 76.3 does not set a time limit for renewal [2].
- After renewal: no lucrativa for 2 years, employment and self-employment for 4 years, family reunification for 4 years, arraigo for 1 year (arraigo familiar for 5 years), DNV for 2 years; if you are entitled to larga duración, you apply for it instead of renewing [1][2].
- The Supreme Court judgment of 8 July 2026 annulled article 197.2 of the Reglamento: the list of renewals with mandatory electronic filing no longer applies in its previous form [3].
- Fees and documents depend on the ground; the amounts of fees for immigration procedures are set by Orden PJC/617/2025, which is referred to in Real Decreto 316/2026 [4]. Amounts for each regime are not included in this article.
Residence permit renewal in Spain: the general procedure
Residence permits are renewed under the rules of the Reglamento (Real Decreto 1155/2024), while permits under Ley 14/2013 (remote work, highly qualified professionals, entrepreneurs and others) follow a separate procedure. The general rule: the application is filed within the two months before expiry, filing extends the validity of the previous authorisation until a decision is made, and filing within three months after expiry also extends it, without prejudice to any penalty procedure under article 52.b of Ley Orgánica 4/2000 [1]. The general rule on this is set out in article 200: the permit’s term ends, but its validity is extended if the renewal, modification or update was requested in time [1].
| Regime | Decision period | Renewed for | Article |
|---|---|---|---|
| No lucrativa | 3 months, silence means approval | 2 years, or larga duración if you are entitled | 64 [1] |
| Employment | 3 months, silence means approval | 4 years, or larga duración | 80, 81 [1] |
| Self-employment | 3 months, silence means approval | 4 years, or larga duración | 86, 87 [1] |
| Family reunification | 3 months, silence means approval | 4 years, depends on the reagrupante’s permit | 71 [1] |
| Arraigo (prórroga) | Article 132 does not set a period | 1 year; arraigo familiar 5 years | 125, 132 [1] |
| DNV and others under Ley 14/2013 | Article 76.3 does not set a period | 2 years | 76.3 [2] |
For the DNV there is a separate guide: DNV renewal after three years. For no lucrativa: no lucrativa renewal. For study, a separate prórroga applies (article 55).
When to apply for renewal and what "extends its validity" means
The window for the main regimes: two months before the expiry date and three months after (articles 64.1, 80.1, 86.1, 71.1, 132.3); details are in the article when to apply for residence permit renewal [1]. Applying within this period extends the validity of the previous authorisation until a decision is made: you remain lawfully resident while the authority reviews your case [1]. Applying within three months after expiry also extends validity, but a penalty is possible for the delay [1]. Under Ley 14/2013, the window for the DNV is 90 days after expiry under the law and 60 days before under the UGE document [2][5].
It is not a good idea to apply in the last few days: if a requerimiento arrives, you may not have enough time to respond and gather documents. How to respond to a requerimiento depends on what exactly was requested; the deadline for responding is stated in the request itself.
What is checked at renewal: conditions by permit type
- No lucrativa (article 64): funds for the renewal period under article 62, health insurance throughout the period and beyond, schooling for minor children, the fee paid, and actual residence in Spain for more than 183 days in a calendar year. Criminal records and compliance with tax and Seguridad Social obligations are also assessed, and a favourable integration report from the autonomous community is taken into account when one of the conditions is not met [1].
- Employment (article 80): continuity of the employment relationship, or a period of activity of at least three months a year with a new contract, or other cases in the article; unpaid contributions do not prevent renewal if genuine activity is proven [1].
- Self-employment (article 86): continuity of the activity and a check of tax and Seguridad Social obligations [1].
- Family reunification (article 71): valid permits for the reagrupante and the reagrupado, the family relationship or union still in place, schooling for the children [1].
- Arraigo (article 132): for arraigo de segunda oportunidad, sociolaboral and social you must be looking for work and registered with the employment service; for socioformativo, a certificate from the institution that you have moved up to the second year [1].
For permits under Ley 14/2013, the law refers to the conditions that gave the right to the permit still being met [2].
Documents for renewal: the general set
The package depends on the ground, but it almost always includes: an application on the official form, your full passport, documents proving that the regime’s conditions are met, proof of payment of the fee and, if there are school-age children in the family, a certificate of their schooling [1]. For no lucrativa, article 64.3 expressly names the passport, documents on funds and insurance, and the children’s schooling certificate [1]. For family reunification, documents showing the marriage or union still exists are added [1]. Lists by ground: renewal document checklist. Fee amounts depend on the regime and are shown on the authority’s page.
How to apply: step by step
- Find the expiry date on your permit and TIE; note it down along with the end of the window.
- Check the conditions of your regime: funds, insurance, work, children’s schooling, residence in Spain, taxes and contributions [1].
- Gather the documents and arrange translations where they are needed.
- Pay the fee and keep the receipt [1].
- Submit the application. Article 197.1 allows filing in person at the oficina de extranjería and filing electronically; the general list of renewals with mandatory electronic filing in article 197.2 was annulled by the Supreme Court judgment of 8 July 2026, published in the BOE on 22 September 2026 [1][3]. A representative can file with a notarised power of representation, apud acta, or under a representation agreement (article 197.4) [1].
- Keep proof of submission: it confirms that the validity of the previous authorisation has been extended [1].
- Respond to a requerimiento if one arrives; keep an eye on notifications in the sede.
- After the decision, within a month, apply in person for a TIE for the new period (articles 64.9 and 81.2) [1].
For the DNV and other permits under Ley 14/2013, applications and renewals are filed electronically through the sede of the Ministry of Inclusion [2][5].
Missed deadline or no reply
If you applied within three months after expiry, the validity of the previous permit is extended, but a fine procedure may be opened [1]. For the main regimes, silence after three months means approval [1]. How to confirm silence and its consequences are covered in the article what silencio positivo is, and if refused, appeal deadlines apply: residence permit refusal: first steps. If the deadline has been missed entirely: expired residence permit: what to do.
Renewal or switching to another status
If your period of residence already entitles you to larga duración, you apply for it instead of renewing: the Reglamento says the renewal is valid for two years “salvo que corresponda larga duración” [1]. See the conditions and the difference in temporary or permanent residence permit. If your ground has ended, a modification to another permit under article 191 is possible for residencia temporal, but not for every type: the list of exceptions is in the same article [1]. How to change ground: changing the residence permit ground.
Common mistakes
- Assuming renewal deadlines are the same for everyone. They differ by regime, and the DNV follows a separate rule [1][2].
- Waiting until the last week of the window and not having time to respond to a requerimiento.
- Not keeping insurance and funds in place for the whole period (no lucrativa) or not keeping track of the 183 days of residence [1].
- Changing jobs without checking how it will affect the renewal conditions (article 80) [1].
- Confusing renewal with modification: when the ground changes, the procedure is different [1].
- Taking fees and deadlines from old articles: after the Supreme Court judgment and the 2026 changes to the Reglamento, the wording is changing [3].
