- Within three months after the permit expires, you can still renew. An application in this period extends the validity of the previous permit until a decision is made, but the authority may open an infringement case [1][2].
- A delay of up to three months is a minor offence under article 52.b LO 4/2000, with a fine of up to €500 under article 55. This is the maximum, not an automatic amount [2].
- If more than three months have passed, the window is closed: article 53.1.a LO 4/2000 classes staying with a permit that expired more than three months ago as a serious offence, with a fine of €501 to 10,000. In some cases, under the principle of proportionality, expulsion is possible instead of a fine [2].
- A permit renewed on an application filed in the three-month period after expiry takes effect retroactively from the first day after expiry: for employment and self-employment this is stated expressly in articles 81 and 87 of the Reglamento [1].
- For the DNV, the law sets 90 days after the permit expires (article 76 Ley 14/2013). What to do in a later situation depends on the ground and your history; this is a matter for a lawyer [3].
Missed your residence permit renewal in Spain: what to work out
Take your resolution and find the exact date the permit expires. Then count how many calendar months have passed since then. The Reglamento (Real Decreto 1155/2024) gives a renewal window: two months before expiry and three months after. An application filed in either of these periods extends the previous permit until a decision is made [1].
| Situation | What it means | Provision |
|---|---|---|
| You applied before the permit expired | The permit is valid until the decision | arts. 64, 80, 86 Reglamento [1] |
| No more than three months have passed since expiry | You can still apply, the permit is extended, a fine of up to €500 is possible | art. 64.1 Reglamento; arts. 52.b, 55 LO 4/2000 [1][2] |
| More than three months have passed since expiry | Renewal is not provided for; serious offence, fine of €501-10,000 or expulsion | arts. 53.1.a, 55, 57 LO 4/2000 [1][2] |
| DNV under Ley 14/2013 | The application is accepted within 90 days after expiry | art. 76.3 [3] |
For no lucrativa this is also built into the renewal conditions: you must hold a valid permit or be within three months after its expiry [1]. The ministry’s information sheets use the same words [4]. More on deadlines: when to apply for residence permit renewal.
If less than three months have passed: what to do
- File the application as soon as possible, without waiting for a perfect package. The filing date within the three-month period protects you, and the authority can request anything missing through a requerimiento [1].
- Use the form for your ground: EX-01 for no lucrativa, EX-03 for employment, EX-07 for self-employment [4][5][7]. List of documents: checklist by ground.
- Keep the receipts for the application and the fee. When you apply electronically, the fee is paid at the moment of filing (Orden PJC/617/2025, article 2.3); the ten working days mentioned in the ministry’s information sheets apply to in-person filing [4][8].
- Watch for notifications: in this period you may receive both a requerimiento and a notice that infringement proceedings have been opened. Both must be answered on time: how to respond to a requerimiento.
- Do not plan a trip abroad without checking how you will get back: autorización de regreso.
For employment and self-employment, articles 81 and 87 state expressly that the effect of the renewed permit is “backdated” to the day after the previous one expired. So if the renewal is approved, there is no gap in documents for these categories [1]. Article 64 has no such provision for no lucrativa, so check in the resolution how the authority sets the dates.
If more than three months have passed
After three months the application window is closed. For no lucrativa, one of the renewal conditions is a valid permit or a period of no more than three months after its expiry, and if you apply later this is not met [1]. For employment, self-employment and reunification, the same three months are set out in articles 80, 86 and 71 [1]. In other words, a “renewal” application in this case has no basis in the article on renewal.
The law does, however, set out the consequences: article 53.1.a LO 4/2000 classes as a serious offence being in Spain with a permit that expired more than three months ago, if no renewal application was filed within the set period [2]. For a serious offence, article 55 sets a fine of €501 to 10,000, and article 57.1 allows expulsion instead of a fine under the principle of proportionality, after separate proceedings and a reasoned decision; a fine and expulsion are not imposed together [2]. Limitation periods: two years for serious offences, six months for minor ones [2].
Which options remain depends on the ground, how long the overstay is, family circumstances, residence history and documents, so we do not give general recommendations. You need to show your history to a lawyer as soon as possible: the range of options often depends on how quickly you seek help. If the permit was not renewed and you received a refusal, see first steps after a refusal.
Fines and expulsion: what exactly the law says
Minor offence under article 52.b: a delay of up to three months in applying for renewal after the permit expires, with a fine of up to €500 under article 55.1.a [2]. Serious offence under article 53.1.a: staying with a permit that expired more than three months ago, without a renewal application filed in time, with a fine of €501 to 10,000 under article 55.1.b [2]. The amount is set taking into account the degree of fault, possible harm and the offender’s financial situation [2].
Expulsion instead of a fine is possible for offences under article 53.1.a, but “by virtue of the principle of proportionality” and after special proceedings with a reasoned decision [2]. There are categories of people who are not expelled, except in special cases: long-term residents, people born in Spain who have lived there lawfully for the last five years, recipients of certain benefits [2]. Whether you fall under these exceptions is determined by a lawyer based on your documents.
We have not found open official statistics on how often a fine or expulsion is actually applied for late renewals specifically. Do not assume either that “nothing will happen” or that “they will definitely expel you”.
How a lapse affects long-term residence, citizenship and work
Permanent residence and citizenship require lawful, continuous residence [1][6]. A period without a permit does not count as lawful residence. So an overstay of more than three months may shift the date from which the five years for permanent residence or the ten years for citizenship are counted. Public sources do not say exactly how the authority treats short overstays within three months; this is one of the points that needs individual analysis. How to calculate: how to count the five years.
Working without a valid permit is a separate offence. Article 53.1.b LO 4/2000 classes working without a work permit as a serious offence if you do not hold a valid residence permit [2]. If you applied on time or within the three-month period after expiry, the permit is extended and this offence does not arise. After three months the situation is different.
Digital nomad visa: 90 days after the permit expires
For a DNV permit, article 76 of Ley 14/2013 accepts a renewal filed within 90 days after expiry and extends the permit until a decision is made, “without prejudice to any penalty proceedings” [3]. The law does not say what happens if you apply later. The LO 4/2000 provisions on offences make no exceptions for particular categories of permit and refer to a permit that expired more than three months ago [2]. So with the DNV, too, it is better not to leave things to the last moment. UGE practice: DNV renewal.
Common mistakes after missing the deadline
- Waiting “until all the documents are ready” and going beyond the three months.
- Counting from the date on the TIE card rather than from the permit expiry date in the resolution: check both.
- Not responding to a notice that infringement proceedings have been opened, thinking it is a formality.
- Filing a template “renewal” after three months instead of asking a lawyer which procedures are possible at all.
- Leaving Spain “for a while” without assessing the consequences for returning and for future applications.
- Carrying on working as an employee or self-employed without a valid permit.
When you need an urgent review
You urgently need a specialist if more than three months have passed since the permit expired, if you have received a notice of proceedings, if you are planning a trip or do not have a valid passport, or if children or a spouse whose permit depends on yours are relying on you. What matters here is the order of steps and speed, not a general checklist.
