- Desistimiento: you can withdraw your application at any time (Article 94 Ley 39/2015), and the administration can treat you as having withdrawn if you do not correct the defects in time (Article 68) [1].
- The time limit to respond to a requerimiento is 10 days as a general rule, with an extension of up to 5 days in case of particular difficulty (Article 68). For a number of procedures the Reglamento sets 10 days or up to 15 days [1][2].
- Caducidad del procedimiento occurs when the procedure has stalled through your fault: the administration warns you, and three months later it archives the case (Article 95) [1].
- Caducidad de la autorización is something else: the permit expires at the end of its term. A renewal filed on time keeps it valid until the decision (Article 200.1 RD 1155/2024) [2].
- Both desistimiento and caducidad are formalised in a decision that can be appealed; the time limit for appealing is stated in the decision itself [1][3].
What is desistimiento?
Desistimiento is the withdrawal of an application, after which the procedure ends without a decision on the merits. Article 84 Ley 39/2015 lists it as one of the ways a procedure ends, along with a decision, waiver of the right and caducidad [1]. It can happen in two ways.
The first is voluntary. Any interested party may withdraw their application; the form is free, but it must carry the signatures the law requires. The administration accepts the withdrawal straight away and ends the procedure, unless third parties have joined the proceedings and ask for it to continue (Article 94) [1].
The second is being “treated as having withdrawn” (tener por desistido). If the application is incomplete, the administration sends a requerimiento: correct the defects within 10 days; the time limit can be extended by up to 5 days if gathering the documents is objectively difficult. If you do not respond, it will issue a decision stating that you have withdrawn your application (Article 68 Ley 39/2015) [1].
What are the deadlines for a requerimiento in immigration procedures?
| Procedure | Time to respond | Legal basis |
|---|---|---|
| General rule | 10 days, extension of up to 5 days | Ley 39/2015, Article 68 [1] |
| Visa: failure to attend when summoned by the consulate | No more than 15 days; 10 days to respond to a request, extension of up to 5 | RD 1155/2024, Article 27 [2] |
| Initial residence permit for employment | 10 days | RD 1155/2024, Article 77 [2] |
| Residence permit for family members of a Spanish citizen, and arraigo | Time limit stated in the notification, no more than 15 days | RD 1155/2024, Articles 97 and 130 [2] |
For the DNV we did not find a separate time limit in Ley 14/2013, so the general rule applies, but always check the number of days in the notification itself. How to respond to a request is explained in our article on requerimiento, and for the UGE also in the article on the DNV requerimiento.
What is caducidad?
In immigration texts this word means two different things, and confusing them is dangerous.
Caducidad del procedimiento: the procedure ends because of your inaction. If the case has stalled for a reason that depends on you, the administration warns you that the procedure will be closed in three months. If you have not done what is needed in that time, the case is archived, and that decision can be appealed (Article 95.1 Ley 39/2015) [1]. Simple inaction on non-essential steps is not grounds for caducidad: you just lose the right to that step (Article 95.2) [1].
Caducidad de la autorización: the permit’s term has ended. Stay and temporary residence permits end when their term expires, but an extension, modification or renovación filed on time keeps them in force until the decision (Article 200.1 RD 1155/2024) [2].
How do these concepts differ?
| Concept | What happens | When |
|---|---|---|
| Voluntary desistimiento | You close your own application | At any time before the decision [1] |
| Desistimiento after a requerimiento | You are treated as having withdrawn | After you miss the time limit to respond [1] |
| Caducidad del procedimiento | The procedure is archived | Three months after the warning [1] |
| Caducidad de la autorización | The permit stops being valid | When its term expires, if you did not file a renewal on time [2] |
What happens after desistimiento or caducidad?
The administration must issue a decision that simply records the circumstance: desistimiento, caducidad or waiver of the right (Article 21.1 Ley 39/2015) [1]. The decision is served stating whether it ends the administrative route, which recursos are available and within what time limits (Article 40.2) [1]. Typical time limits: recurso de reposición one month, recurso de alzada one month, and the court accepts a claim within two months of the date of the express decision [1][3]. Which recurso applies to your decision is written in the decision itself; the general procedure is described in the article on reposición and alzada. Do not confuse desistimiento with the authority’s silence: these are different situations; on silence, see silencio positivo.
Desistimiento in itself does not mean you cannot apply again. But a new application is assessed on the conditions at the date it is filed, and what happens to the validity of your previous permit and to the time limits depends on the date and the type of case. Article 200.1 links the extended validity of a permit to the renewal procedure being in progress; the text does not say what happens to this protection after archivo. This is a question for a lawyer before you file a second application.
How do you avoid desistimiento over a missed requerimiento?
- Open the notification in the sede on the day you receive it and write down the date and the time limit: how notifications work in the sede.
- Compare the number of days in the document with the table above: for your procedure it may be different.
- If you cannot obtain a document in time, ask for an extension of up to 5 days before the time limit runs out: it is possible in case of particular difficulty and is never automatic.
- Respond through the same channel and keep the proof of submission.
- If you receive a decision of desistimiento, show it to a lawyer straight away: the time limit for a recurso runs from the day it is served.
What is possible in your case depends on the type of procedure. Appeals are not included in ReloVictory’s case handling fee, but corrections and resubmission are. For renewals, the steps are set out in the renewal route card, and a general overview of residence grounds is on the Residence permit in Barcelona page.
