Who it suits and who it doesn’t
A work residence permit is tied to a specific job or project. First we work out your route, then we gather the documents.
Fits
- You have a job offer from a Spanish employer: the employment route, cuenta ajena
- You have your own project or professional activity with licences and investment: cuenta propia
- You are a professional with a university degree or proven experience, and a company is ready to sign a contract with a salary above the threshold: the EU Blue Card or the national option for highly qualified professionals
- You want to stay in Spain after your studies or change status while already here: the procedure is set by articles 190 and 191 of the Reglamento
Does not fit
- You work remotely for a foreign company: see the digital nomad residence permit
- You live on savings and do not plan to work: a residence permit without the right to work will suit you
- You have neither an employer nor a project: a work permit is issued for a specific activity
- You want to start working before you get the permit: that is not allowed
If you are choosing between employment and your own business, start with the article employment contract or autónomo. The difference between cuenta propia and the entrepreneur residence permit is explained in emprendedor or cuenta propia.
Requirements for the three routes
Employment and self-employment are governed by the Reglamento (Real Decreto 1155/2024). The Blue Card and the national card for highly qualified professionals are governed by Ley 14/2013, articles 71 and 71 bis.
| Route | Requirement | In practice |
|---|---|---|
| Employment (cuenta ajena) | Contract for the full term of the permit | The start date is tied to the permit taking effect. Terms in line with the law and the collective agreement. For part-time work, the annual salary is at least the full-time minimum wage |
| Employment (cuenta ajena) | Labour market situation (article 75) | The occupation is on the list of hard-to-fill occupations, which the employment services update every quarter, or the employer proves through the employment service that no local worker was found. There are exceptions under article 40 of LO 4/2000 |
| Employment (cuenta ajena) | Reliable employer | No tax or social security debts, funds for the project and the salary. An individual employer also proves funds for their own family |
| Cuenta propia | Requirements for starting the business, as for Spanish nationals | Licences, registrations, professional association membership, if the profession requires them |
| Cuenta propia | Qualifications or experience, sufficient investment | A project with investment figures and its impact on employment. Self-employment also counts as employment |
| Highly qualified | Degree (at least three years of study) or five years of experience; for ICT, three years out of the last seven | Regulated professions require degree recognition (homologación) |
| Highly qualified | Contract or firm offer of at least six months | Filed by the company or the professional |
| EU Blue Card | Gross annual salary not below the threshold | According to UGE data for June 2026: general threshold €41,356.36, reduced €33,085.09. The national option has a single threshold, €41,356.36. The threshold is recalculated, so we check the figure before filing |
| All routes | No criminal record, fee paid; for the UGE, also insurance and funds | Certificates from your countries of residence, translated as the authority requires, a medical certificate for the visa, payment with modelo 790 |
The reduced Blue Card threshold applies to some occupations in groups 1 and 2 of the CNO-2011 classification and to people who gained their qualification no more than three years ago. More: highly qualified professional and EU Blue Card in Spain.
What limits the first permit
The first employment permit is issued for the length of the job, for no more than a year, and is tied to a region and an occupation. The first cuenta propia permit is valid for a year and is tied to a region and a sector. After the four-year renewal you can work in any region and sector, as an employee or on your own account (articles 73, 81, 83, 87). During the first year, you can change employer within the same occupation once the permit has been valid for three months. As long as employment remains your main activity, you can also work on your own account (article 73.5).
Step-by-step application
Employment, cuenta ajena
- Labour market and contract. The employer checks the list of hard-to-fill occupations or goes through the procedure with the employment service, then signs a contract on the official form.
- The employer applies at the oficina de extranjería where the work will take place. If the region has devolved powers over initial work permits, the regional body takes the application (articles 77 and 194).
- Decision within three months; silence means refusal.
- Visa. You apply within a month of the employer being notified; the consulate issues the visa within a month.
- Entry, alta and TIE. Social security registration within three months of entry, otherwise the permit does not take effect; then the TIE within a month.
Cuenta propia
- Project with licences, investment figures and proof of qualifications.
- Visa. A non-resident applies at the consulate, and the application includes the permit application (article 85). Decision within three months; silence means refusal.
- Entry, alta and TIE within the same time limits as for employment.
Highly qualified professional and Blue Card
- Checking the contract and the salary threshold.
- Filing with the UGE electronically, by the company or the professional (what the UGE is). Decision within twenty days; silence means approval.
- Visa for the Blue Card with no extra requirements, and a TIE if the permit is valid for more than six months.
The Tribunal Supremo struck down mandatory electronic filing under article 197.2 of the Reglamento in judgments of 8 and 29 July 2026, so we check the filing method before each application.
Documents
- From the employer, for employment: company identifier and proof of the representative’s authority, contract on the official form, proof of funds, and for an individual employer the IRPF return for the previous year
- From you: whole passport, degree or proof of experience, criminal record certificates, medical certificate
- For cuenta propia: project, licences and registrations, proof of investment, proof of qualifications
- For the UGE: contract or offer, proof of the salary threshold, homologación for a regulated profession, insurance and proof of funds
We always adapt the list to your country and consulate. Sworn translations and apostilles are paid separately: what makes up the price of a translation. Social security: NUSS number and RETA and alta. Do not upload documents to the website: once we start work, we will tell you what to send and where by e-mail.
Timeframes
| Stage | Statutory time limit |
|---|---|
| Decision for employment and cuenta propia | Up to three months, silence means refusal |
| UGE decision | Twenty days, silence means approval |
| Visa after the decision | Apply within a month, issued within a month |
| Social security alta | Three months after entry |
| Renewal for employment and cuenta propia | File two months before expiry, late filing possible within three months, decision in three months, silence means approval, four-year term |
| UGE renewal | File 60 days before expiry or within 90 days after, two-year term |
| First highly qualified card | Three years or the contract term plus three months |
We do not control consulate queues or authority processing times. On taxes: tax residence and residence permits.
Common mistakes
- A contract not tied to the permit. The start date must depend on the permit taking effect. Check the terms with the article employment contract in Spain: what to look for.
- The employer is not ready for the checks. Tax and social security debts stop the case. The company’s steps: how an employer hires a foreign national.
- Cuenta propia without investment or licences. An idea without documents does not get through. The procedure: cuenta propia in Spain and autónomo registration.
- Using an old figure for the Blue Card threshold. It changes. Regulated professions also need degree homologación.
- Alta not done on time. For cuenta propia, if the three months pass, you have to leave Spain.
- Confusing a residence permit with tax residence. They are separate checks.
How we work and what is paid separately
Case handling: from €1,452 incl. IVA, family member +€605. All prices.
First consultation: 15 minutes free. Full individual consultation: €121 for 45 minutes. After that we price the work individually and draw up an estimate, which you sign before we start. Advance payment: 50% before work begins and 50% before filing. Government fees and translations are paid separately. We handle the case until the authority decides. Corrections in response to requests and a resubmission are included in the price; an appeal is not. We do not promise approval and are not responsible for how long public bodies take to reply: the decision is made by a government authority.
We work with you and the employer. The employer decides on hiring and the contract terms; the team’s lawyer deals with employment law questions. Tax and administrative matters are handled by the tax and administrative specialist (graduada social). We prepare and check the employer’s application and the professional’s file together with them.
