Spanish entrepreneur visa or cuenta propia: which to choose

The Spanish entrepreneur visa (emprendedor, articles 69-70 of Ley 14/2013) suits an innovative project or one of special economic interest and requires a favourable ENISA report, whereas cuenta propia (articles 82-87 of RD 1155/2024) suits an ordinary self-employed business. The choice depends on the project itself, not on a convenient timeline.

Information material, not an individual legal opinion. Conditions apply to each specific situation and may change.
In brief
  • Emprendedor: an activity that is innovative, of special economic interest for Spain, or both; a favourable ENISA report; electronic application to the UGE. Initial term of three years, renewal for two [1][3][4].
  • Cuenta propia: an ordinary business or profession of your own, licences, sufficient investment, filing through a consulate, a decision within three months with silence meaning refusal. Initial term one year, renewal for four [2][5].
  • ENISA assesses the applicant’s profile, the business plan (project, product or service, financing) and the added value for the economy; the report is issued within ten working days [1][3].
  • The size of the investment does not determine the category: under neither regime does the law set a “minimum amount”. For cuenta propia you prove that the investment is sufficient; for emprendedor the project is assessed [1][2].
  • Registering a company does not replace the personal permit under either option [1][2].

Two logics: an innovative project or an ordinary business

It all comes down to what you are creating. Emprendedor, Spain’s entrepreneur visa, is a separate route under Ley 14/2013 for a project that is innovative or of special economic interest for Spain; it needs a favourable ENISA report [1]. Cuenta propia is the general regime for self-employed activity: there the authorities check licences, qualifications and whether the investment is sufficient, and innovation does not matter [2]. The authority draws a clear line between the Ley 14/2013 categories and the general regime: they were deliberately left out of the regulation [4].

Who the emprendedor route suits

The key concept here is “actividad emprendedora”: an activity that is innovative, of special economic interest, or both. Not every start-up or internet project qualifies, and a website or the word startup in your pitch deck does not change the assessment. ENISA looks at three groups of information. First, your professional profile and your involvement in the project (if there are several partners, each one is assessed). Second, a business plan describing the project, the product or service and the financing, including the investment and where it comes from. Third, what brings added value and innovation [1]. A polished presentation does not create immigration grounds.

There are three steps. Fill in the project form on the ENISA website (the report is sent to the UGE). Put together the file: MIT form, fee under modelo 790 038 item 7, passport, and a criminal record certificate for those in Spain on a stay (estancia). Submit the application through the UGE electronic system; the project’s technical documentation goes to ENISA [3]. More on the conditions and the report: start-up visa in Spain.

Who cuenta propia suits

Cuenta propia suits a shop, café, workshop, consultancy, studio, construction firm and other businesses that do not have to prove innovation but must meet the rules that apply to citizens: licences, qualifications, membership of a professional association (colegiación), sufficient investment and the effect on employment, including self-employment [2][5]. In Catalonia, the core of the file is the project memoria, and the Generalitat provides guides and a support service. Step-by-step procedure: cuenta propia: residence permit for the self-employed. Setting up an SL does not answer the question of which to choose: the company and the permit are separate tasks; more in the article on autónomo and SL and on an SL for a non-resident.

Why the size of the investment is not decisive

Do not look for an “advertised minimum investment”. Ley 14/2013 refers to a business plan and financing, including the required investment and its sources, not to a universal amount [1]. Article 84 of the RD requires you to show that the investment is sufficient for your project, again without a figure [2]. Buying equipment or a stake shows a financial step, but not necessarily that you fit the category, and it does not replace the check of the applicant’s personal requirements.

For planning, separate three budgets: preparing the immigration case, setting up the business, and running it until sales are stable. That way the cost of professional support will not be mistaken for the total cost of moving.

How to choose: questions before the consultation

  1. What are you creating? An ordinary local business or a professional practice is usually closer to cuenta propia. If the core is a technology, product or model that can be described as innovative, it makes sense to discuss emprendedor [1][2].
  2. What licences and authorisations do you have? For cuenta propia they are mandatory and are evidenced in the file [2][5].
  3. Where are you now? An emprendedor application can be filed both by people in Spain who hold a stay, residence or visa, and by people abroad [1]. Cuenta propia from abroad goes through a visa at the consulate, while from within Spain a change of grounds is possible [2].
  4. What term do you need? Three years with a two-year renewal versus one year with a four-year renewal [1][2].
  5. Who is coming with you? The family of an emprendedor is processed under article 62.4 [1]; for cuenta propia, the family conditions have to be checked separately.

Depending on your answers, draw up a written comparison: the actual activity and your role, clients and evidence of demand, licences, sources of financing, and the reasons why the project fits the chosen category. Ask a specialist to name the facts that support the route and the conditions not yet met. Sham contracts and artificial figures to make the application look good create a risk of refusal for false information.

Common mistakes when choosing

  • Treating an SL or setting up a company as grounds for emprendedor. The law assesses the project and the applicant, not the legal form [1].
  • Calling any internet project innovative. The assessment uses the criteria in the law; how you describe it yourself does not count [1].
  • Applying for cuenta propia without licences. This is a condition of article 84 and part of the document file [2][5].
  • Mixing up the time limits. Three months with silence meaning refusal for cuenta propia and 20 days with silence meaning approval for emprendedor belong to different procedures [1][2].
  • Not separating personal living costs from the business budget. Plans with a single combined budget are hard to verify.
  • Taking a revenue forecast as fact. State which assumptions are backed by agreements and which are not.

When you need an individual review

You need a review if the project is on the borderline between innovative and ordinary, if there are several partners, if you need to change your grounds from within Spain, if the business needs licences or colegiación (professional association membership), or if you combine the business with employment.

Frequently asked questions

Is registering a company enough to get an entrepreneur residence permit?
No. Setting up a legal entity does not replace the requirements for the applicant’s personal permit, their activity and the project itself. Emprendedor requires a favourable ENISA report; cuenta propia requires proven licences and investment [1][2].
Does any internet project count as innovative?
There are no grounds to assume so. ENISA assesses the substance of the project against the criteria of the law: the applicant’s profile, the business plan, added value and innovation [1]. Having a website or the word startup in your pitch deck does not change the assessment.
How much do you need to invest for emprendedor or cuenta propia?
The law sets no minimum amount for either regime. For emprendedor, the business plan and financing are assessed; for cuenta propia, you prove that the investment is sufficient for your project [1][2]. The amount depends on the type of activity.
Can you apply for emprendedor while in Spain?
The law allows applications both from people who already hold a stay, residence or visa in Spain and from people abroad [1]. From abroad, you apply for a visa once the permit is granted [1]. Whether this route suits your status depends on the case.
How long are emprendedor and cuenta propia permits valid?
Emprendedor: three years, renewal for two, permanent residence possible in the fifth year [1][4]. Cuenta propia: one year in one region and sector, renewal for four years nationwide [2]. The conditions must be proven again on renewal.
Can you later switch from one category to the other?
For the DNV, the UGE explains that you can switch to another permit under Ley 14/2013 if you meet the conditions of the new one [6]. We found no separate guidance for emprendedor; a switch to the general regime goes through Title XI of the regulation if the conditions of the new grounds are met [2].
Who pays the fee and how much?
For emprendedor, the fee is paid under modelo 790 038 item 7, online, with an NRC number [3]. For cuenta propia, the codes are modelo 790 052 and 062 [5]. The amounts are listed on the authorities’ pages and change; translations and apostilles are paid separately.
