Residence permit renewal in Spain: preparation by permit type

A residence permit renewal is filed in a window around the permit’s expiry date: as a general rule, in the two months before expiry and up to three months after. The set of documents depends on the basis, and below we go through it for each type of permit.

Where should you start with a Spanish residence renewal?

Start with the decision granting your current authorisation: its legal basis determines the renewal procedure, requirements and deadlines. Non-lucrative residence, work, family, study and digital nomad routes do not share one universal checklist. Compare the authorisation with your current income, work, healthcare cover and family circumstances. Then check whether renewal or another procedure fits. ReloVictory helps organise documents and follow-up within the agreed service; a prepared file does not guarantee the authority’s decision.

Next steps

  1. Gather the current decision, passport and TIE; resolve conflicting dates before calculating the application window.
  2. Find the rule for your authorisation and separately check the consequences of filing after its expiry.
  3. Review changes in employment, resources, healthcare cover, family relationships and any other conditions attached to the permit.
  4. List the supporting documents, the period each must cover and the applicable translation requirements.
  5. Keep the application and registration receipt, monitor notifications and respond within the deadline stated in any request.
  6. After the decision, check TIE and family-document steps; renewing a card is not the same as renewing the underlying authorisation.

When to file for renewal: windows and consequences

The filing window in the Reglamento (Real Decreto 1155/2024) is almost always the same: the application is filed within the two months before the permit expires. Filing in this period extends the previous permit until the decision. Filing within three months after expiry also extends it, but the authority may open a penalty procedure. The text of the law says “two months” and “three months”, not “60 and 90 days”, as many websites write.

What the law says about the consequences. A delay of up to three months after expiry is a minor offence (article 52 of Ley Orgánica 4/2000), with a fine of up to €500. If more than three months have passed since the permit expired, the window is closed: article 53 of the same Ley Orgánica classes this as a serious offence, with a fine of €501 to 10,000.

A hypothetical example. The permit is valid until 15 March 2027. The “before” window opens around 15 January 2027, and the three-month “tail” ends around 15 June 2027. The Reglamento does not spell out how to count months or whether the first day counts, so it is more practical to file in the middle of the window rather than on the first or last day. Full breakdown: when to file for residence permit renewal.

Steps

  1. Find the expiry date. It is on the resolution and on the TIE card. If the dates differ, we count from the earlier one and check with the authority.
  2. Check the conditions of your basis. Funds, insurance, work or activity, children’s schooling, days of residence in Spain, taxes and contributions.
  3. Gather the documents. Order translations and apostilles where new certificates are needed: renewal document checklist.
  4. Pay the fee. It is modelo 790, and the code depends on the basis. According to the ministry’s information sheets, the fee becomes due on filing and must be paid within ten working days. Keep the receipt: how to pay the fee online.
  5. Submit the application. Through the electronic sede or, for some bases, in person at the oficina de extranjería. A representative files with a notarial proxy or through apud acta (article 197): digital certificate and representative. The Supreme Court struck down mandatory electronic filing under the list in article 197.2 on 8 July 2026, so we check the method on the filing date.
  6. Watch for notifications. If a requerimiento arrives, you have 10 working days to respond: how to answer a request and how to check your expediente.
  7. After the decision, apply for your TIE. You have one month from the notification of the renewal to apply for the card (articles 64 and 81): TIE and huellas.

Documents by permit type

Every renewal needs the same basic set: an application on the official form, a copy of the whole passport and the paid fee. If you have school-age children, you need a certificate from their school: without it the authority gives you a month, and if it is still missing the permit is not renewed. Foreign documents are filed with a sworn translation and an apostille.

BasisFormWhat you prove
No lucrativaEX-01Funds and insurance for the whole renewal period, insurance already in force before, children attending school, more than 183 days in Spain in the calendar year (details)
EmploymentEX-03Continued employment: with the same employer no other documents are needed; if you changed jobs, the new contract; if you lost your job, proof of that and registration with the employment service
Self-employmentEX-07Continued activity. The authority checks taxes and contributions itself and also requests the criminal record certificate itself
Family reunificationPer the information sheetBoth passports, proof of marriage or partnership, the sponsor’s valid permit
ArraigoPer the information sheetFor most types, job search and registration with the employment service; for socioformativo, a certificate from the school confirming progression to the second year
StudyPer the information sheetThat the original conditions still hold: enrolment and studies, funds, insurance (details)
DNVElectronically via the UGEThat the conditions that gave you the right to the permit still hold

The authority also takes your “integration effort” into account. A favourable report from the autonomous community proves it, and it helps when one of the conditions is not met: integration report in Catalonia.

DNV renewal follows a different procedure

The digital nomad permit is renewed not under the Reglamento but under article 76 of Ley 14/2013: for two years, as long as the conditions that gave you the right to the permit still hold. The application is filed electronically through the UGE. If it is filed within 90 days after the permit expires, the permit also stays valid until the decision, without prejudice to any infringement proceedings. The article sets no deadline for filing before expiry, so we file early and do not plan on the late window. The DNV renewal fee is listed in the tasa table under code 038 on the authority’s page; check it before you pay.

We have not found an official list of documents for DNV renewal in public sources. It makes sense to prepare the contract or a letter from the employer, proof of income, insurance and proof of social security registration. Any change in the conditions must be reported to the UGE within 30 days (Ley 14/2013, additional provision 7, point 2). In detail: DNV renewal after three years and the digital nomad residence permit page.

Renew or apply for long-term residence

If you already have five years of continuous legal residence, a larga duración permit may suit you instead of a renewal (article 183 of the Reglamento). Absences of up to six months in a row do not break continuity, as long as they add up to no more than ten months over five years.

The difference between the statuses: residence permit or permanent residence and larga duración and larga duración-UE. How to count the five years: permanent residence in Spain and five years of residence. How time abroad affects renewal: long absences and residence permit renewal.

Common mistakes

  • Assuming the windows are the same for every permit type. DNV and studies have their own rules.
  • They leave filing to the last days of the window, then a requerimiento arrives and documents are missing.
  • Treating the three-month late window as spare time. It is there for the unexpected, not for planning: you may be fined.
  • For no lucrativa, showing funds for one month instead of the whole renewal period, with insurance that ends too early.
  • They don’t bring the school certificate for children of compulsory school age.
  • Forgetting the passport: if it is no longer valid and you have not started replacing it, the permit is liable to be terminated (article 200 of the Reglamento).
  • Not keeping the receipt and a copy of the file: without them it is hard to prove you filed on time.
  • Leaving Spain without checking how you will get back: autorización de regreso and travel during renewal.

How we work and what is paid separately

Case handling: from €650 incl. IVA, family member +€450. All prices.

First consultation: 15 minutes free. Full individual consultation: €121 for 45 minutes. After that the cost is quoted individually, and you sign the estimate before work starts. Prepayment: 50% before work starts and 50% before filing.

We handle the case until the authority’s decision. Corrections in response to requests and refiling are included in the price; an appeal is not. Government fees and translations are paid separately and appear as separate lines in the estimate. Response times are set by the authority: we are not responsible for them and we do not promise approval.

  1. Review. We check the resolution, the expiry date and the permit type, work out your filing window and set up a calendar.
  2. Documents. We draw up the list for your permit type and arrange translations and apostilles.
  3. Filing. We file on your behalf where the law allows a representative (notarised proxy (poder notarial), apud acta, registered representative). Where you must file in person (consulate, arraigo), we prepare the file and go with you. We prepare answers to a requerimiento together with you.
  4. After the decision. TIE, a plan for the next renewal or a move to long-term residence.

Book a consultation

For the first conversation, a description of your situation is enough. Do not upload documents to the website: once we start work, we will tell you what to send and where by e-mail. More about the terms in questions and answers.

Frequently asked questions

Is the filing deadline the same for all permits?
No. The deadline depends on the specific procedure. The DNV is governed by Ley 14/2013, and many other permits by the Reglamento de Extranjería. The renewal rules for estancia por estudios are also checked separately.
Can I apply for renewal after my permit has expired?
Yes, within three months after expiry. Your previous permit is then also extended until the decision, but the authority may open infringement proceedings: a minor infringement carries a fine of up to €500. After three months the window is closed and you need an urgent review.
What happens if the authority doesn’t respond in time?
For no lucrativa, employment, self-employment and family reunification, three months of silence means approval. For renewing a study estancia the time limit is one month, and silence means refusal. For no lucrativa and employment, the authority issues a certificate of renewal by silence at the applicant’s request.
Can I leave Spain while my renewal is being processed?
It depends on the documents you hold. A ticket does not prove your right to re-enter, and the card may have expired. Before buying tickets, check your passport, permit and return document: details in the article on the autorización de regreso.
How much does renewing a residence permit in Spain cost?
The government fee depends on the permit type: modelo 790 with its own code; check the amount on the authority’s page. For DNV renewal, the amount is listed in the tasa table under code 038; check it before you pay. The cost of our work is quoted individually and fixed in the estimate before we start.
For how many years is a residence permit renewed?
No lucrativa for 2 years; employment, self-employment and family reunification for 4 years; DNV for 2 years; arraigo for 1 year; arraigo familiar for 5 years. If you already qualify for larga duración, you apply for it instead of renewing.
What should I do if my renewal is refused?
First work out the appeal deadline, which is short, then look at the reason for the refusal. An appeal is not included in the price of our work, but we will go through the options in a consultation.
What documents do I need to renew a residence permit?
An application on the official form, a copy of the whole passport, the paid fee and the documents for your permit type: funds and insurance for no lucrativa, proof of work or activity for employment and self-employment, a school certificate for children. Foreign documents are filed with a sworn translation and an apostille.
Do I need to renew my residence permit if I already have five years of residence?
Not always. After five years of continuous legal residence, larga duración may fit, and then you apply for it instead. Whether you qualify depends on your absences and your status history: check before filing.
If I have changed employer, is it enough to renew the card?
A change of job means checking the conditions of your current permit and any notices or procedures it requires. Booking a TIE appointment does not settle this; the status and the changes are reviewed first.
