Non-lucrative residence

Renewing a no lucrativa permit: deadlines, documents and checks

A no lucrativa renewal is filed with the oficina de extranjería within the two months before the permit expires: filing extends the old permit until a decision is made. The authority decides within three months, silence means approval, and the new permit is issued for two years.

Information material, not an individual legal opinion. Conditions apply to each specific situation and may change.
In brief
  • The no lucrativa renewal is filed within the two months before the permit’s expiry date. Filing within this period extends the validity of the previous permit until the decision (article 64 of the Reglamento) [1].
  • If you are late, filing within three months after expiry also extends the old permit, but a penalty procedure may be opened [1].
  • The decision period is three months. Unlike the first application, on renewal the authority’s silence means approval: the application is deemed granted [1].
  • Conditions for renewal: funds for the new period, insurance, school for the children, the fee and actual residence in Spain for more than 183 days in a calendar year [1].
  • The renewed permit is valid for two years, unless you qualify for the long-term category. The TIE is applied for within a month of the decision [1].

When to apply for no lucrativa renewal

Under article 64 of the Reglamento de extranjería (Real Decreto 1155/2024), the renewal application is filed within the two months before the permit’s expiry date. Filing within this period extends the validity of the previous permit until the renewal decision [1]. This means you can wait for the answer in Spain lawfully, even if your card has already expired.

Filing within three months after the permit expires also extends its validity until the decision, but the law states that this does not rule out an infringement procedure under article 52.b) of Ley Orgánica 4/2000 [1]. Being late is not something to plan as a normal route. If the deadline has already passed, see what to do if your residence permit has expired.

What is checked at no lucrativa renewal

Article 64 lists the conditions for renewal [1]:

  • you hold a valid no lucrativa permit or are within the three-month window after its expiry;
  • you have sufficient funds for maintenance and accommodation for the new period, in the amounts set by article 62;
  • you had and still have seguro de enfermedad (health insurance) throughout the permit;
  • school-age children who depend on you attend school;
  • the fee has been paid;
  • you have actually and effectively lived in Spain for more than 183 days in a calendar year.

Besides the mandatory points, the authority may assess whether tax and Seguridad Social obligations have been met, and may take a criminal record into account if there is one [1]. Esfuerzo de integración (integration effort) is assessed separately: a favourable report from the regional authorities on knowledge of the language and values can help, especially if one of the conditions is not met [1]. In Catalonia this report is prepared under a specific procedure: informe de integración in Catalonia.

If there is no favourable report from the regional authorities but it was requested in time, its absence does not close the matter: when the report has not been issued within a month and you can prove this, integration effort can be shown by any admissible evidence (article 64.6) [1]. The law does not specify what exactly will be accepted in Barcelona.

183 days of residence and travel on a no lucrativa

The law frames the 183-day condition as actual and effective residence “durante el año natural”, that is, in a calendar year [1]. Article 64 does not say which calendar year counts, the year of filing or the last completed one. We have found no official clarification and advise assuming the worst: build up more than 183 days in every calendar year the permit is valid.

The fact that the figure matches tax residence does not make the tests the same. For tax in Spain the rule in article 9 of Ley 35/2006 applies, taking into account the centre of economic interests, while for renewal the oficina de extranjería looks at documents showing residence: empadronamiento, rental contract, utility payments, entry and exit stamps [1]. Keep your travel history to hand: absence from Spain and residence permit renewal.

If you plan to leave while the application is being processed, bear in mind that the mere fact of filing does not replace a document for the border. For this there is the autorización de regreso, which lets you leave and return within 90 days provided you have already started the renewal procedure [2]. More: autorización de regreso.

What documents you need to renew a no lucrativa

The application on the official form is accompanied by [1]:

  • a full copy of your valid passport or travel document;
  • documents on funds for the renewal period and on insurance for that period;
  • if you have school-age children, a report from the regional authorities confirming schooling;
  • the fee payment receipt (modelo 790);
  • optionally, an integration report and other documents supporting your circumstances.

The law says “entre otros” (among others): the oficina de extranjería may request additional evidence. The practical list for your oficina may be longer and should be checked in advance. For the general checklist see documents for residence permit renewal. How to calculate the amount for the new period: financial means for no lucrativa.

If the documents do not show that the children are in school, the authority passes the information to the education authorities and warns you in writing: you are given one month to provide proof, otherwise the permit will not be renewed [1].

How to renew a no lucrativa: step by step

  1. Work out the expiry date. From the TIE card and from the decision. Mark the date two months before it as the start of the filing window.
  2. Check the conditions. Funds, insurance, school, days of residence. Do not wait until the last week.
  3. Gather the documents and pay the fee. The receipt is needed for the application.
  4. File the application. The Tribunal Supremo rulings of 8 and 29 July 2026 removed mandatory electronic filing for the no lucrativa renewal: article 197.2, which introduced it, was declared void [3][4]. You can file in person at the oficina de extranjería or through the sede electrónica. A representative can file with a notarial power (poder notarial) or an apud acta authorisation in the electronic register, and registered professional representatives can also file (article 197.4) [1].
  5. Keep the receipt and the set you submitted. This is the only proof of the filing date.
  6. Watch for notifications. A requerimiento (request for documents) must be answered on time, how to respond to a requerimiento.
  7. After the decision, apply for the TIE. You have one month from the date of notification of the renewal to apply for the card [1].

Decision deadline and administrative silence

The renewal application must be decided and notified within three months of filing. Once this period has passed, the application is deemed granted (silencio positivo) [1]. This is the key difference from the first no lucrativa application, where silence means refusal. Confirmation of silence is issued as a document, and how it is accepted when booking a TIE appointment, by banks and by employers depends on practice.

The renewed no lucrativa permit is issued for two years, unless you qualify for a long-term residence permit [1].

Common mistakes when renewing a no lucrativa

  • Filing the day before expiry and without documents. The two-month window exists so you can prepare calmly [1].
  • Not reaching 183 days and finding out from a requerimiento. Count your days in advance [1].
  • Copying the first application. Family composition, sources of funds and the period change, and you need a fresh calculation [1].
  • Forgetting about insurance for the past period. The law requires it to have been in force for the whole time of the permit, not on the day of filing only [1].
  • Overlooking school. School-age children need a report from the regional authorities [1].
  • Treating renewal as a work permit. No lucrativa remains a permit without the right to work; a change of ground is handled separately under article 191: how to change your residence permit ground [1].

When you need an individual review

It is worth ordering a review if you spent less than 183 days in Spain, if your family composition or source of funds has changed, if you have had problems with tax or Seguridad Social, if you have no proof of insurance for the whole period, or if you want to move into work. What exactly will weaken the application and whether it can be fixed depends on your case, and this is checked by a lawyer and a gestor.

Frequently asked questions

How many months in advance should you apply for the no lucrativa renewal?
Within the two months before the permit expires. Filing within this period extends the previous permit until the decision. After expiry you can file within three months, but an infringement procedure is possible [1].
How long does the no lucrativa renewal take?
Three months from filing. If there is no decision within this time, the application is deemed granted. For a first application the rule is the opposite: there silence means refusal. The law does not explain how to prove silence in practice [1].
For how long is no lucrativa renewed?
For two years, unless you qualify for a long-term residence permit. After the decision you must apply for the TIE in person at the police within a month [1].
Do you need to live in Spain for more than 183 days for renewal?
Yes, article 64 requires actual and effective residence for more than 183 days in a calendar year. The law does not specify which year counts, so it is safer to reach this period every calendar year [1].
Can you leave Spain while the renewal is being processed?
The mere fact of filing does not replace a document for the border. To leave and return you apply for an autorización de regreso for no more than 90 days, if the renewal procedure has already started and the filing deadline was met [2].
What if your funds are lower than at the first application?
Funds are proven again for the renewal period in the amounts set by article 62. If the amount is insufficient, this is a ground for refusal, but the authority assesses the circumstances, including esfuerzo de integración. The case should be reviewed before filing [1].
Can you start working while the no lucrativa renewal is being processed?
No. Renewal does not give the right to work. To work you need to change the ground to a permit for employment or self-employment, which is a separate procedure under article 191 of the Reglamento [1].
