- The general rule: two months before the permit expires and three months after. This is what the Reglamento (Real Decreto 1155/2024) says for no lucrativa, employment, self-employment, family reunification and permits on exceptional grounds [1].
- An application filed in the “before” window extends the previous permit until a decision is made. Filing in the three-month “tail” also extends it, but the authority may open penalty proceedings: under Article 52.b LO 4/2000 this is a minor offence, with a fine of up to €500 [1][5].
- The authority’s silence is treated differently: for no lucrativa, employment and self-employment the application is deemed approved after three months, while for a student estancia it is deemed refused after one month [1][2][3].
- The DNV is governed by Ley 14/2013: to switch from the visa to the permit, the law gives 60 calendar days before the visa expires; for renewal of the permit, 90 days after it expires. The law does not state a “before” period for renewal [4].
- The fee becomes payable when you file: for online filing it is paid straight away (Orden PJC/617/2025, Article 2.3); the ten working days mentioned in the ministry’s information sheets apply to in-person filing [2][9]. After a favourable decision you have one month to apply for the TIE card [1].
Deadlines for renewing a residence permit in Spain: general rule and table
The filing window is the same in almost all the Reglamento articles on renewal: two months before the expiry date and three months after it. For no lucrativa this is Article 64, for employment Article 80, for self-employment Article 86, for family reunification Article 71, and for permits on exceptional grounds (arraigo) Article 132 [1]. The text says “dos meses” and “tres meses”, not “60 and 90 days”, so the figures 60 and 90 that appear on blogs are inaccurate for the general regime.
| Ground | When to apply | If the authority does not respond | Provision |
|---|---|---|---|
| No lucrativa | 2 months before, 3 months after | approved after 3 months | Art. 64 Reglamento [1][2] |
| Employment | 2 months before, 3 months after | approved after 3 months | Art. 80 [1][3] |
| Self-employment | 2 months before, 3 months after | approved after 3 months | Arts. 86 and 87 [1] |
| Family reunification | 2 months before, 3 months after | approved after 3 months | Art. 71 [1] |
| Student estancia (prórroga) | 2 months before, 3 months after | refused after 1 month | Art. 55 [1] |
| Arraigo (prórroga) | 2 months before, 3 months after | not stated in the article | Art. 132 [1] |
| DNV (Ley 14/2013) | before: not stated; after: 90 days | see the DNV section | Arts. 74 quater, 76 [4] |
For the long-term resident card (larga duración) the same “two months before, three after” window applies, but this window is for renewing the TIE itself, not for renewing the permit: missing the card renewal deadline does not in itself end your status (Articles 178 and 185) [1]. More on the differences: larga duración and larga duración-UE.
What filing on time gives you and what happens after the permit expires
An application filed in the “before” window extends the previous permit until a decision on the merits. The same wording is repeated for the three-month period after expiry: an application filed during it also extends the permit, “without prejudice to the opening of infringement proceedings” [1]. This means your legal stay continues, but the authority keeps the right to start administrative proceedings for a fine.
The law states the consequences directly. Article 52.b of Ley Orgánica 4/2000 classifies as a minor offence a delay of up to three months in applying to renew a permit that has already expired, and Article 55 sets a fine of up to €500 for minor offences [5]. We have not found official statistics on how often the authority opens such proceedings.
If more than three months have passed since the permit expired, this is no longer a “late renewal application”: the window is closed, and Article 53.1.a of the same law classifies staying with a permit that expired more than three months ago as a serious offence [5]. What to do in that case is covered in a separate article: missed residence permit renewal.
How to work out the filing date: an example
Say your resolution states that the permit is valid until 15 March 2027. The “before” window opens around 15 January 2027, and the three-month “tail” after expiry ends around 15 June 2027. The word “around” is honest here: the Reglamento does not specify whether the first day counts or how to count months of different lengths, so it is better not to file on the first or last day of the window [1].
Aim for the middle of the window, not its edges. Filing in the first days after the window opens means your income, insurance and housing documents need to be ready about two months before the permit expires. Filing in the last days leaves you no margin for any mistake in the application.
This is what is checked at the time of filing. For no lucrativa you need funds and insurance for the renewal period, and actual residence in Spain for more than 183 days in the calendar year [1][2]. For employment you need to show that the employment relationship continues or one of the grounds listed in Article 80 [1][3]. For self-employment the authority itself checks that your taxes and Seguridad Social contributions are in order [1].
Extending an estancia por estudios: same window, different silence rule
For a student estancia Article 55 also gives two months before expiry and three months after, but the response time and the effect of silence are different: if no decision is received within a month, the application is deemed rejected [1]. The number of extensions is limited: depending on the category, one or two extensions are allowed per permit [1].
The extension is based on your study documents: enrolment for the next year, payment of tuition and your results. The documents are covered in detail in the article on extending a student estancia.
Digital nomad visa renewal: what Ley 14/2013 says
The permit for international teleworkers (DNV, the digital nomad residence permit) has its own rule. Article 74 quater gives the visa holder the right to apply for the permit within 60 calendar days before the visa expires, provided the conditions are still met. Article 76 allows the permit to be renewed for two years, and an application filed within 90 days after the permit expires also extends its validity, “without prejudice” to possible infringement proceedings [4].
Article 76 says nothing about how early before expiry you can apply for renewal. We have not been able to establish from public sources whether the general “two months before” from the Reglamento applies to the DNV, so to be safe, go by the shorter 60-day window and do not file earlier. At each stage the authority checks that the conditions that gave you the right to the permit are still met, and the ministry may request reports and check compliance [4]. Applications through the UGE are handled entirely online: see what the UGE is and DNV renewal after three years.
Any change in the conditions on which you were admitted (for example, a change of employer) must be reported to the UGE within 30 days [4]. Failing to report it may lead to a review and, if the conditions are no longer met, to termination of the permit after a hearing [4].
What to get done before you apply
- Passport. If your passport is no longer valid, the permit is subject to termination unless you prove that you have started replacing it (Article 200 Reglamento) [1].
- How to file. The general obligation to file renewals only online (Article 197.2 Reglamento) was annulled by the Supreme Court in rulings of 8 and 29 July 2026, published in the BOE on 22 September 2026 [8]. Article 197.1 still allows filing both through the sede and in person at an oficina de extranjería, so check the method on the day you file. Online filing requires a digital certificate or a representative; the DNV is filed online through the UGE.
- Fee. For no lucrativa this is modelo 790, code 052; the fee becomes payable when you file: for online filing it is paid straight away, for in-person filing within ten working days [2][9]. For employment and self-employment codes 052 and 062 are used; for employment, the second fee is paid by the employer [3][7]. Overview: tasas 790.
- The ministry’s information sheets (Hoja 7, 13, 15) show the current list of documents and form numbers: EX-01 for no lucrativa, EX-03 for employment, EX-07 for self-employment [2][3][7].
Common deadline mistakes
- People put off filing until the last days of the “before” window and then find that a certificate or a translation is missing.
- People treat the three-month “tail” as a normal buffer. It is there for the unexpected, not for planning: a fine is possible [5].
- People confuse the validity of the permit with the validity of the TIE card. The permit is defined by the resolution; for some statuses the plastic card may expire earlier or later.
- People apply the general Reglamento window of “two months before, three after” to the DNV without noticing that Ley 14/2013 has its own deadlines: 60 days before the visa expires to switch to the permit, and 90 days after the permit expires for renewal [4].
- People file after their student estancia expires as calmly as they would for a work permit renewal: for a student, the authority’s silence means refusal [1].
- People do not keep the receipt and the full set of documents filed. Without them it is hard to prove that the application was filed on time.
- People travel abroad without checking the re-entry procedure (autorización de regreso) while their TIE has expired and the renewal is being processed.
When you need an individual review
If your permit has already expired, if you are changing your residence ground along with the renewal, if your income, family composition or employer has changed since your first application, or if you are not sure under which article your permit was granted, it is better to decide on the filing date with a specialist. The same word “renewal” covers different rules, and in the Reglamento each category has its own conditions and its own rule on the authority’s silence [1].
