- The Certificado electrónico de ciudadano FNMT is free for adults who hold a DNI or NIE. A foreigner obtains it as follows: an online application, a code sent by email, and identity verification in person at an office. Video identification requires an electronic DNI and costs €2.99 plus taxes [1][2][3].
- UGE applications under Ley 14/2013 require an electronic certificate. Through Mercurio, applications are filed with a certificate or DNIe and the Autofirma program [4][5][6].
- A representative acts under a power of representation: apud acta in the electronic register, a notarial document, or agreements (convenios) with professional representatives or entry in the colaboradores register. Article 5 Ley 39/2015 requires proof of authority for applications and appeals [7][8].
- In judgments of 8 and 29 July 2026 the Tribunal Supremo declared void article 197.2 RD 1155/2024 on mandatory electronic communication for some applications: the general conclusion that “every foreigner must have a certificate” is wrong. For UGE applications under Ley 14/2013, electronic filing remains a requirement of the UGE itself [4][9][12].
- An electronic notification is deemed received when it is accessed. If the electronic form is mandatory or was chosen by you and you have not opened it for ten calendar days, it is deemed rejected [7].
What certificado digital is and why a foreigner needs it
The Certificado electrónico de ciudadano (also called the certificado de persona física) is issued by the FNMT-RCM, the state mint and printing works. It links the holder to a signing key and confirms their identity online: with it you file applications, receive notifications, pay taxes and view your cases [1]. For a foreigner the main tasks are: filing an application with the UGE, adding documents to a case already filed, logging into the authorities’ personal areas, and signing the fee payment form.
The FNMT states that any Spanish citizen or foreigner who is an adult or emancipated and has a DNI or NIE can obtain the certificate, and that it is free [1]. In everyday speech, “certificado digital” covers the file itself, its password and the Autofirma application used to sign documents. These are three different things.
How a foreigner gets a certificado digital: steps
The FNMT describes four ways to obtain the certificate file: video identification, verification in person at an office, DNIe and a mobile device [1]. Not all of them work for someone with an NIE.
- Setup and online application. You install the required software and fill in the application. An application code is sent to your email [2].
- Identity verification at an office. You go in person to one of the Oficinas de Acreditación de Identidad. For a foreigner, the FNMT lists the application code and the NIE card together with a passport, or the official document assigning the NIE together with a passport. AEAT and Seguridad Social offices require a prior appointment [2]. Post offices do not issue these certificates [2].
- Download. After verification the certificate can be downloaded straight away, and the FNMT recommends doing so without delay. Make a backup copy [2][3].
Video identification requires a valid electronic DNI and costs €2.99 plus taxes; the certificate itself is free [3]. This rules out that route for an NIE card holder, who is left with the office. If you cannot attend in person, a third party can go, but the FNMT requires your signature on the contract to be notarised in advance. An ordinary power of representation does not replace this notarisation [2].
Where certificado digital is needed for a residence permit
The requirements depend on which authority handles your procedure.
| Procedure | What the official pages say | Source |
|---|---|---|
| UGE applications under Ley 14/2013 (DNV and others) | Filing and all documentation (subsanaciones, additions, recursos) only electronically through the sede of the Ministry of Inclusion. An electronic certificate is required to file [4]. The procedure page names a DNIe or a certificate [5] | UGE, sede [4][5] |
| Applications to the Delegación del Gobierno through Mercurio | A certificate or DNIe and the Autofirma program. Lawyers, gestores administrativos and graduados sociales can use their own access through the Consejo General of their profession [6] | sede AP [6] |
| Viewing cases and notifications | A certificate or Cl@ve [10] | Punto de Acceso General [10] |
Cl@ve lets you log into personal areas and Mi Carpeta Ciudadana, but for filing UGE applications the pages name a certificate or DNIe. Details: Cl@ve and Mi Carpeta Ciudadana. On the portals themselves and the filing procedure: applying for a residence permit through the sede electrónica.
How to file on your behalf without handing over the certificate
The law solves this not by handing over the key but by proving representation. Article 5 Ley 39/2015 allows you to act through a representative, but for applications, appeals and waivers of rights the representation must be proven. For “mero trámite” actions it is presumed. It can be proven by any means that reliably records the authority: apud acta, by appearing in person or electronically at the sede, or by entry in the electronic register of powers of representation (apoderamientos). If there is no proof or it is incomplete, the action is not lost: the authority gives ten days to provide it [7].
For extranjería procedures, article 197.4 RD 1155/2024 sets out three routes for when the applicant is in Spain: a power of representation before a notary or apud acta in the electronic register; special agreements (convenios) with professional representatives; inclusion in the Registro Electrónico de Colaboradores de Extranjería [8]. The sede of the Ministry of Inclusion for applications under Ley 14/2013 states plainly that the legitimate applicant can appear electronically and appoint another person through the apodera application (register of powers of representation, code 201361) [5]. The UGE information note on the DNV says that the application can be filed in person or through a legal representative, attaching a document that entitles them to sign applications and submit documents [11].
| Method | What the representative does | What stays with you |
|---|---|---|
| You file yourself with your own certificate | Prepares the set of documents and checks the form | Signature, access to the certificate and notifications |
| Representative under a power of representation | Files and signs on your behalf using their own access | Control over the scope and duration of the authority |
| Professional representative with access rights | Uses their own access in Mercurio or the colaboradores register | A contract listing the actions |
The conclusion is simple: nobody but you needs the certificate file and password. If someone you hire asks for them “for convenience”, that is a reason to stop and grant a power of representation instead. Choosing who to hire and their status: gestor or lawyer.
Electronic communication: what the Tribunal Supremo decided
Article 197.2 RD 1155/2024 listed the procedures in which individuals are required to deal with the authorities electronically: for example, renewal of the no lucrativa permit and initial residence with employment. In its judgment of 8 July 2026 (published in the BOE on 22.09.2026) the Tribunal Supremo declared this article void in its entirety. The court left the regulator free to impose such an obligation for particular categories of procedures, provided it is justified and proportionate under article 14.3 Ley 39/2015. The ruling was repeated in the judgment of 29 July 2026 [8][9][12].
Two conclusions follow. The statement that “every foreigner must have a personal certificate for any procedure” needs correcting. But the opposite, “electronic filing is now optional”, is also wrong: for UGE applications the Ministry of Inclusion itself requires electronic filing, and professional representatives who are obliged to work electronically under article 14.2 Ley 39/2015 remain under that regime [4][7]. Check with a lawyer or gestor what applies in your case.
Notifications: who receives them and how
Notifications in electronic procedures arrive at the authority’s sede, at the single electronic address DEHú or in the Mi Carpeta Ciudadana personal area. To log in you need a certificate or Cl@ve [10]. An electronic notification is deemed received when you or your representative open its content. If the electronic channel is mandatory for you or you chose it yourself, and it was not accessed for ten calendar days, the notification is deemed rejected (article 43 Ley 39/2015) [7]. An email, under the law, can only alert you that a notification exists; it does not replace it [7].
If you have a representative, as a general rule actions in the case go through them (article 5.1 Ley 39/2015), unless you have expressly stated otherwise [7]. So it is worth putting in the contract who logs into the sede every day, how quickly they tell you about a new document and where they forward the full text. The deadline for responding to a requerimiento runs from the notification: how to respond to a requerimiento.
Common mistakes
- Sending the person you hired your certificate file and password “to file the application”. A power of representation is enough.
- Obtaining the certificate through a link sent by an intermediary. Start from the official FNMT page [1].
- They give verification codes to someone who claims to be from customer support.
- Not agreeing in writing who monitors notifications, and missing the ten-day window to open them.
- Taking a screenshot as proof of filing. You need the official registration document: in Mercurio, after registration you can obtain an electronic resguardo in PDF [6].
- Believing that Cl@ve replaces the certificate for UGE filing. The pages name a certificate or DNIe [4][5].
- Not revoking the power of representation and not changing the contact details for notifications once you stop working with the person you hired.
When you need an individual review
A review is needed if you are abroad and cannot attend an FNMT office in person, if you are applying for a family and some of the applicants are minors, if you already have a case with another representative, or if it is unclear which filing regime applies to your procedure after the Tribunal Supremo judgments. There is no single answer: it depends on the procedure and the authority.
How we can help
The ReloVictory team prepares the set of documents and the form for filing, sets up the representative’s authority in the form the specific authority accepts, and agrees with you who monitors notifications and how. The certificate stays with you. About the service: documents and filing.
