- Gestor administrativo: under the Estatuto Orgánico, handles any trámites before public authorities for a fee, provided they do not require the legal expertise reserved for the legal profession [1].
- Abogado: the title and the function of advising and defending are reserved to abogados by law (article 542 LOPJ); to practise, you need a degree and membership of a Colegio de la Abogacía as an ejerciente [2][3].
- Graduado social: by law can act as technical representative in labour proceedings and Seguridad Social cases (article 545.2 LOPJ) [2].
- Any person with legal capacity can represent you before a public authority, but their authority must be proven; in extranjería this means a notarised power of representation (poder notarial) or an apud acta (article 197.4 RD 1155/2024) [4][5].
- In contencioso-administrativo proceedings, a party must have an abogado (article 23 Ley 29/1998) [6].
What is a gestor administrativo?
A gestor administrativo is a professional who, habitualmente and for a fee, promotes, files and handles any trámites on clients’ matters before any public authority and keeps the client informed of the progress of the procedure. The key limitation in the definition: it covers matters that do not require the legal expertise reserved for the legal profession (article 1 Estatuto Orgánico, Decreto 424/1963) [1]. A gestor acts as a representative and belongs to the Colegio de Gestores Administrativos; membership is possible with a suitable degree and after entrance exams. Liability insurance is compulsory [1].
Who is an abogado and how is the role different?
The title and function of abogado are reserved by law to those who professionally defend parties in proceedings or give legal advice (article 542.1 LOPJ) [2]. Under the Estatuto General de la Abogacía, an abogado must hold an official degree and be a member of a Colegio de la Abogacía as an ejerciente: only such a professional may call themselves an abogado [3]. Membership of one colegio gives the right to practise throughout Spain [3]. An abogado must state their colegio and membership number in all their professional acts [3]. What this number means is explained in the article on the ICAB.
Graduado social is the third profession in this group. The law singles out its role in labour proceedings and Seguridad Social cases: there, technical representation can be provided by a graduado social [2]. Colegios de Graduados Sociales are public law corporations [7].
Where is the line between the roles?
| Profession | What the law says | Where to check |
|---|---|---|
| Gestor administrativo | Trámites before public authorities without the legal expertise reserved for the legal profession [1] | Colegio de Gestores, member’s card (carnet) [1] |
| Graduado social | Technical representation in labour and Seguridad Social cases [2] | Colegio de Graduados Sociales [7] |
| Abogado | Advice and defence; mandatory in court in most cases [2][3][6] | National bar censo and the member list of their own Colegio [3] |
The dividing line is one of responsibility: a gestor deals with the procedure, an abogado with the legal dispute. The law does not explicitly list what counts as “legal expertise”, and in practice the line is blurred; it is a question for a consultation on the specific case.
Who can represent you before the authorities?
Under Ley 39/2015 any person with legal capacity can be a representative, but to file an application, lodge an appeal or withdraw an application on someone else’s behalf, the authority must be proven [4]. Proof: any means that reliably records the authority, including an apud acta or an entry in the electronic register of powers of representation (registro electrónico de apoderamientos) [4]. In extranjería, article 197.4 RD 1155/2024 names a notarised power of representation or apud acta, habilitación agreements and members of the Registro Electrónico de Colaboradores de Extranjería [5]. This register was created by Orden ISM/164/2026 for trade unions and non-profit organisations, and help through it is free [8].
So your representative before the authority can be a gestor, an abogado or another person with a power of representation, and you are entitled to submit the documents yourself without a representative. More on whether you need a lawyer: do you need a lawyer for a residence permit.
Who should you choose for your case?
| Task | Who is suitable |
|---|---|
| Gather the documents, pay the fee, book an appointment, apply following a clear procedure | You yourself, a gestor, a graduado social or an abogado |
| Taxes, Seguridad Social, employment documents | Usually a gestor or a graduado social |
| A requerimiento raising a legal question, a refusal, a disputed interpretation of a rule | Abogado |
| Residence permit court case (contencioso-administrativo) | Abogado mandatory [6] |
This is a guide, not a rule: the outcome depends on your case. Before choosing, ask for the colegio and membership number and check them; criteria for choosing a gestor specifically are covered in the article how to choose a gestor. For an abogado, the details are published in the national bar censo [3]; for a gestor, the card is issued by the colegio [1].
