- A gestor administrativo, under the 1963 Estatuto, professionally handles administrative procedures that do not require a lawyer’s legal technique, and keeps the client informed of how the procedure is going [1].
- Gestores belong to regional professional associations (colegios) under a Consejo General. For Catalonia, the Consejo website lists a Colegio for Barcelona, Girona and Lleida [3]; the home page has a “Busca tu gA” search [2].
- A gestor must put on documents their name, a note of colegio membership and a professional stamp, and must cover their liability with insurance [1].
- Representation before the administration must be proven: Ley 39/2015 requires this for applications, appeals (recursos) and waivers of rights [4].
- The outcome and the timing of the decision are up to the authority: a gestor cannot promise either approval or a date [1][4].
How does a gestor administrativo differ from a lawyer?
A gestor administrativo handles administrative procedures, while the law reserves legal technique for lawyers. Article 1 of the Estatuto Orgánico, Decreto 424/1963, defines gestores as professionals who, for a fee, prepare and submit all kinds of procedures “that do not require the application of the legal technique reserved for the legal profession” in matters before the bodies of the Administración Pública, and who keep the client informed of how the procedure is going [1]. The Consejo General describes its profession the same way [2].
For paperwork this is usually enough: filling in a form, paying a fee, submitting an application, watching for notifications. If you need a legal strategy, a reply to a requerimiento with legal reasoning, or an appeal, you need a lawyer. Choosing between them is covered in the article gestor or lawyer.
What should you check before choosing a gestor?
Check membership, identification, insurance, the contract and the quote. The status and duties of a gestor are set out in the Estatuto; below are the criteria and their basis.
| Criterion | What to check | Basis |
|---|---|---|
| Colegio membership | The surname in the register via the Consejo General website (“Busca tu gA”) or the Catalan colegio | Estatuto, arts. 4 and 6 [1][3] |
| Identification | Name, membership note and stamp on documents | Estatuto, art. 24 [1] |
| Insurance | Professional liability insurance policy; you can ask about it | Estatuto, arts. 8 and 24 [1] |
| Confidentiality and records | Professional secrecy; case files kept for five years after completion | Estatuto, art. 24 [1] |
| Representation | A document proving authority to act | Ley 39/2015, art. 5 [4] |
The 1963 Estatuto has been amended; check its current version on the Consejo website or with the colegio itself. We only cite general rules.
What should you ask a gestor before signing a contract?
It is better to ask in advance and get the answers in writing. The list works for any gestor; we do not recommend specific people.
- Are you a colegio member? Show me your number and how to check it on the Consejo or colegio website [2].
- Do you have professional liability insurance [1]?
- What exactly does the work include: preparing documents, paying the fee, submitting, replying to a requerimiento, TIE, renewal?
- Who submits the documents and who receives the notifications? What access will you need to give, to what, and can it be done without handing over a certificate file with its private key? See the article on certificado digital and representatives.
- How is representation set up: apud acta, the electronic register of apoderamientos or another way, and which actions does it cover [4]?
- What is the quote, and which lines are separate in it: fee, state fees (tasas), translations, notary, courier?
- What is not included in the price: appeals, resubmission, urgent requests, fixing someone else’s mistakes?
- How will you get copies: the application, receipts, the decision, correspondence on legally relevant steps?
What should the quote look like and what should the contract include?
The quote should show the gestor’s fee and, separately, what goes to the state and to third parties. You pay fees (tasas) and translations to the authority and to the translator, not to the person handling your case, so they need separate lines. More on fees in the article on tasas 790, on translations in the article on the cost of sworn translation.
Gestor prices are not fixed: the Estatuto requires gestores to work under free competition [1]. There is no single tariff, so compare the list of work, not the final figure. If you have doubts about the size of the fee, the colegio’s Junta de Gobierno can, on request, give its view on the fee note (minuta de honorarios): this is one of its functions [1].
It helps to set out in the contract: the scope of work, the deadline and payment terms, the actions the gestor may take on your behalf, how they will tell you about requests from the authority, the return of documents and revocation of the authority to act.
What should a gestor never promise or ask for?
A gestor cannot promise a decision or a deadline, because the authority sets them. The application is examined by a public body, and the time limits are fixed by law, not by an agreement with whoever handles your case. Under article 24 of the Estatuto, their duties are honesty, keeping you informed and professional secrecy, not guaranteeing the result [1].
Warning signs you can spot straight away:
- “Approval is certain” or “2 times faster than the authority”.
- A request for your online banking passwords. They are not needed to pay a fee.
- An offer to register you at an address where you do not live, or to attach a document you do not have. Difficulties with documents do not justify a false address.
- Refusal to show the contract, the quote or receipts for paid fees.
- Posing as a lawyer, or advising on contentious legal issues without a lawyer.
If you work with us, we prepare an individual quote, fees and translations are paid separately, and we are not responsible for how long authorities take to reply. The first 15 minutes of a consultation are free; book a consultation. What document preparation and submission include is described on the service page documents, and the general procedure for moving on the page Residence permit in Barcelona.
