Residence permit refused in Spain: first steps and how to challenge it

A residence refusal in Spain is not the end of the matter, but the appeal deadline is short and the remedy depends on the authority that decided. A Subdelegación or consulate decision: an optional reposición within a month or a court claim within two months. A UGE decision under Ley 14/2013: recurso de alzada within a month. First step: get the full text of the decision and note the date you opened it.

Information material, not an individual legal opinion. Conditions apply to each specific situation and may change.
In brief
  • First, the full text of the decision. The notification must contain the text itself, a statement of whether the administrative route is closed, the list of recursos, the body and the time limit (article 40 Ley 39/2015). A status in your online account does not replace the document [1].
  • The remedy depends on the body. A decision of the Subdelegación or a consulate: an optional reposición within one month or straight to court (contencioso-administrativo) within two months; alzada cannot be lodged against it, because additional provision 9 of RD 1155/2024 closes the administrative route. A UGE decision under Ley 14/2013: recurso de alzada within one month (article 76.1). How to count the month is explained in the article on appeals [1][2][3][5].
  • A recurso does not by itself stop the decision from being enforced: suspension has to be requested separately (article 117 Ley 39/2015) [1].
  • If you are in Spain without a valid permit, the decision includes an obligation to leave: the deadline is stated in the decision or is no more than 15 days, in exceptional cases up to 90 [3]. Irregular stay is a serious offence carrying a fine of €501 to 10,000 [4].
  • A new application or a recurso: there is no one-size-fits-all answer. It depends on the reason for the refusal, the documents in the file and the deadlines. Corrections and reapplication are included in the ReloVictory case handling fee; appeals are not.

Which remedy applies to you: by the body that decided

The remedy depends on who issued the decision. Additional provision 9 of the Reglamento (RD 1155/2024) closes the administrative route for decisions of the Delegados and Subdelegados del Gobierno on residence and work permits and for consular decisions on visas [3]; against these an optional reposición (articles 123 and 124 Ley 39/2015) and court (article 46 Ley 29/1998) remain. For UGE decisions under Ley 14/2013, article 76.1 names the recurso de alzada [5]. With an express decision, time limits run from the day after notification [1][2].

Who decidedRemedyTime limit
Subdelegación del Gobierno (oficina de extranjería): arraigo, no lucrativa, renewal, reagrupaciónReposición to the same body or straight to courtReposición: one month; court: two months [1][2][3]
Consulate (visa refusal)Reposición before the consulate or straight to courtReposición: one month; court: two months [1][2][3]
UGE (DNV and other permits under Ley 14/2013)Recurso de alzada (article 76.1 Ley 14/2013, articles 121 and 122 Ley 39/2015)Alzada: one month; court after an express decision on the alzada: two months [1][2][5]

If you have lodged a reposición, you cannot go to court until it has been decided or tacitly rejected (article 123.2). How these rules fit together for UGE decisions (article 76 refers to alzada, additional provision 9 to closing the route) we have not confirmed from official sources, so check against the recursos section of the decision itself and the lawyer’s conclusion. How to count time, the stages and how the court works are covered in a separate article: appeals: reposición, alzada and court. By type of residence permit: DNV refusal: reasons and recurso and no lucrativa refusal. If you are unsure about the date, work it out on the very first day.

Residence permit refusal in Spain: what counts as a refusal and how to check

In Russian-language chats the word “refusal” covers different things, and their consequences differ. Before you act, establish which document you actually have [1][3].

What you receivedWhat it meansWhere to look
Resolución denegatoria (refusal on the merits)The authority decided that the requirements were not met. There are reasons and a section on recursos [1]The “recursos” section and the reasons
Silence after the deadlineFor no lucrativa, silence means refusal (article 63 Reglamento); for the DNV, approval (article 76 Ley 14/2013). For arraigo the Reglamento sets no time limit: the ministry’s information sheets give three months and treat silence as refusal [3][5][8]silencio positivo
Inadmisión a trámiteThe application was not admitted for processing; there was no examination on the merits [3]The ground stated in the text
Desistimiento or archivoYou did not answer a requerimiento in time, and the case was closed as withdrawn [3]desistimiento and caducidad
“Desfavorable” status in your online accountThis is an indicator, not a decision. You need the document with the reasons and the notification datehow to check your application status

You are entitled to a copy of your file: article 53 Ley 39/2015 gives an interested party the right to know the progress of the case and the content of the acts, and to obtain copies of documents [1]. How to view the file and notifications: checking your expediente de extranjería.

The first days after a refusal: what to do, in order

  1. Keep the original files. The decision, attachments, proof of submission, earlier requerimientos and your answers to them. A translated paragraph does not replace the document.
  2. Record the notification date. For electronic notifications it is the day you open it, and a mandatory or chosen notification that you did not open is deemed rejected after ten calendar days (article 43) [1]. Time limits run from that date.
  3. Find the section on recursos. If there are no instructions or they are incomplete, article 40 sets out specific consequences, and it is worth going through them with a lawyer [1].
  4. Establish your current status. Whether you have a valid permit or renewal, how long you are entitled to stay in the country, and what the decision says about the obligation to leave [3].
  5. Send the lawyer the whole package in one message and state the notification date straight away. If the deadline is close, say so in the first line.

Negotiating with an agency, waiting for a translation or making another request to the authority does not stop the clock. Time limits run regardless.

What happens to your stay in Spain after a refusal

This is the most sensitive point. An appeal does not by itself stop enforcement, so suspension is requested separately. The body may agree if enforcement would cause harm that is hard to repair or if there are grounds for nullity; and if a registered request receives no answer within a month, enforcement is deemed suspended (article 117) [1].

If the decision refuses a permit or renewal to someone who is in Spain, it contains a warning about the obligation to leave. The deadline is stated in the decision or is no more than fifteen days, and in exceptional circumstances with sufficient means it can be extended to ninety; whoever leaves in time does not receive an entry ban and may return under the general rules (article 24 Reglamento) [3].

Once the deadline has passed, the expulsion regime applies. Being in Spain without a permit, or with a permit that expired more than three months ago, provided no renewal was applied for in time, is a serious offence carrying a fine of €501 to 10,000 (articles 53.1.a and 55.1.b Ley Orgánica 4/2000) [4]. Which of this applies to you depends on the type of refusal, the date and whether you lodged a recurso and a request for suspension.

Refusal of a first application and refusal of a renewal: how the situation differs

When a renewal is refused, you usually had a status, and what happens to it depends on the date the renewal was filed (two months before or within three months after expiry) and on whether filing extends the old permit until the decision [3]. When a first application is refused on grounds where you can apply from Spain (arraigo, change of status), you usually have no permit of your own, and the question of leaving arises immediately. When a consulate refuses a visa, you are abroad, and the time limit for the recurso runs in the same way, but it is lodged differently: the consulate’s decision must state its reasons and include instructions on recursos (article 28 Reglamento) [3]. Filing and language are described in the related articles.

Recurso or a new application: how to choose

There is no universal rule. If the reason can be fixed (a missing document, a mistake in the income calculation, the wrong translation), it is often quicker to reapply with a corrected package. If the refusal is wrong in law or on the facts, and the necessary documents were already in the file, then you are talking about a recurso, that is, challenging the decision itself rather than making a second attempt. You can attach new documents to a recurso, but evidence you could have submitted earlier and did not will not be taken into account (article 118) [1].

Whether you can file a new application in parallel with a recurso, and what that would mean for your status, the official sources do not explain directly, and it is not worth testing by trial. Answering a requerimiento is different from a recurso: missing documents are submitted within the deadline in the request, see how to answer a requerimiento. If the deadline has already passed, read overstayed residence permit: what to do.

What changed in 2026

From 16 April, Real Decreto 316/2026 added condition h to article 126 for arraigo and amended articles 127.c and 130.5. The Tribunal Supremo judgments of 8 July (sentencia 868/2026) and 29 July 2026, published in the BOE on 22 September, annulled several provisions of the Reglamento, including paragraph 2 of article 197 on mandatory electronic filing for certain procedures [6][7][9]. These changes do not automatically cancel your refusal: it all depends on the circumstances, whether the decision is final and which remedies are available. Nobody can promise you an “annulment” to get a new decision.

Common mistakes after a refusal

  • Counting a month as 30 days. The counting rule is in article 30; details in the article on appeals [1].
  • Waiting for explanations from the agency or consulate. The time limit runs from the day of notification [1].
  • Hoping the recurso will stop enforcement. Suspension has to be requested separately [1].
  • Going to court without waiting for the answer to the reposición. The court will not accept such a claim [2][1].
  • Sending the recurso through the wrong channel. A consulate does not accept e-mail, the UGE accepts electronic filing: check with the body.
  • Not keeping the date the notification was opened. It starts the time limits [1].
  • Choosing a lawyer by an advertised win rate. It does not show whether an argument applies to your case.

When you need an individual review

Almost always. The time limit is measured in weeks, and the choice between alzada, reposición, court and a new application depends on the text of the decision, the body, the notification date and the documents. Bring the full text, proof of the notification date and everything filed earlier. Opinions on specific cases are given by a lawyer after studying the documents; this article does not replace them.

How we can help

The ReloVictory team in Barcelona analyses the reasons for the refusal, calculates the time limits from the text of the notification and assesses what can be fixed for a new application; the choice between reposición, alzada, court and a new application is made by the team’s lawyer after studying the decision. First step: send the notification date and the full text of the decision. Booking: consultation.

Frequently asked questions

How long do you have to appeal a residence permit refusal?
For an express decision, one month for an alzada or reposición and two months to bring a claim in court, starting from the day after notification. Which remedy is yours is shown in the decision. There is no universal 30-day time limit [1][2].
Can you file a new application instead of appealing?
Often you can, if the reason for the refusal can be fixed, but there is no universal answer. You need to compare the reasons for the refusal, the documents in the file and the deadlines. Filing in parallel with a recurso is not officially explained; check with a lawyer [1].
Do you have to leave Spain after a refusal?
If you are in the country without a valid permit, the decision contains an obligation to leave: the deadline is stated in the decision or is no more than 15 days, in exceptional circumstances up to 90. No entry ban is imposed on someone who leaves in time [3].
Does a recurso stop the refusal from being enforced?
As a general rule, no. Suspension has to be requested separately: the body may agree if enforcement would cause harm that is hard to repair or if the decision is null. No answer within a month: enforcement is deemed suspended [1].
Do you need a lawyer to challenge a refusal?
Ley 39/2015 does not require a lawyer for administrative recursos; you can act yourself or through a representative (article 5), but the time limit is short and choosing the remedy is complex. In court you are assisted by an abogado; this is mandatory. Free legal aid is available on the conditions set by law [1][2][4].
What if the authority’s silence means refusal?
It is a refusal by law and can be challenged, but first find out which kind of silence applies in your procedure: for no lucrativa and arraigo silence means refusal, for the DNV approval. The time limits for a recurso and a court claim are counted differently after silence than after an express decision [1][2][5].
Do the 2026 Supreme Court judgments correct my refusal?
Not automatically. The judgments annulled certain provisions of the Reglamento, but the effect on your case depends on the circumstances, whether the act is final and the remedies available. A lawyer assesses this based on your decision [7][9].
