- Two options: the EU Blue Card (at least three years of higher education or five years of experience) and the national permit (MECES level 1 or three years of experience). Both are governed by article 71 of Ley 14/2013, not by the general regulation [1][4][5].
- Salary threshold according to UGE data as of June 2026: for the Blue Card €41,356.36 gross a year, reduced to €33,085.09 in two cases. The national permit has a single threshold: €41,356.36 [2].
- The company or the professional applies to the UGE online. A decision is due within 20 days, and silence means the permit is granted. The initial term is up to three years, and the permit is valid throughout Spain [1][6].
- The company registers with the UGE once, for three years. Changes in conditions must be reported within 30 days, otherwise the company is removed from the register [1].
- The national labour market situation is not taken into account for highly qualified professionals. A high salary alone does not define the category [1][3].
Where the highly qualified professional residence permit is regulated
This is not the ordinary work permit under Real Decreto 1155/2024. Highly qualified professionals fall under the “international mobility” section of Ley 14/2013 (article 61, articles 71 and 71 bis), and the regulation removed the EU Blue Card from its text because Ley 14/2013 governs it [1][4]. According to the ministry, these categories are excluded from the general regime, and the general rules of the regulation apply to them only in a very narrow sense [5]. The familiar idea that “all work residence permits are processed the same way” does not hold here. The Tribunal Supremo judgments of 8 and 29 July 2026 concerned the regulation, and their operative parts say nothing about these categories [7][8].
Compare it with the ordinary employment route: residence permit with an employment contract.
| Criterion | General employment regime | Highly qualified professional |
|---|---|---|
| Who applies | The employer, to the authority where the job is based (in Catalonia, the Generalitat) | The company or the professional, online via the UGE [1][6] |
| Labour market | Checked | Not taken into account [1][3] |
| Decision deadline | Three months, silence means refusal | 20 days, silence means approval [1] |
| Initial term | Up to one year, limited to a region and occupation | Up to three years, the whole country [1] |
EU Blue Card and national permit: comparison
| Criterion | EU Blue Card | National permit |
|---|---|---|
| Education or experience | Higher education of at least three years (EQF level 6) or five years of professional experience; in ICT, three years of experience within the last seven | Education at MECES level 1 (5A) or three years of experience; details in the instructions [1] |
| Contract | Contract or binding job offer for at least six months | Highly qualified employment or professional relationship [1] |
| Gross annual threshold (June 2026) | 41 356,36 € | 41 356,36 € [2] |
| Reduced threshold | €33,085.09 for CNO-2011 group 1 and 2 occupations in the difícil cobertura catalogue, and for a degree no more than three years old | Not applicable [2] |
| Regulated profession | Degree homologation | Required under the general rules for the profession [1] |
The threshold is tied to the average salary according to INE data (€29,540.26 for 2024) and is revised: the rule is set by Orden PJC/44/2026, and the UGE publishes the updated figure [2]. Employees of international companies have a separate category: intra-corporate transfer (ICT).
How the application works: UGE, timelines and permit validity
Permits under Ley 14/2013 are handled by the Unidad de Grandes Empresas y Colectivos Estratégicos, and everything is done online through the ministry website: the application, corrections, replies and enquiries [6]. Either the company or the professional can apply; in the second case, the UGE tells the company that the application has been received [1]. The decision is due within 20 days of online submission, silence means the permit is granted, and a refusal is appealed through recurso de alzada [1]. For the visa, the consulate replies within 10 working days unless a consultation under the Visa Code rules is required [1].
The permit is issued for three years. If the contract is shorter, it is issued for the length of the contract plus three months, but for no more than three years. 60 days before expiry you can apply for a two-year renewal if the conditions still hold, and after five years long-term residence becomes possible [1]. If the permit is valid for more than six months, you need a TIE [1]. The duration rule for this category is confirmed by DGGM criterion 2/2025 [5].
The company confirms once that it meets the requirements and is entered in the UGE register for three years, renewable. Changes in conditions must be reported within 30 days, otherwise the company is removed [1]. The employer’s steps when hiring a foreign national: how to hire a foreigner in Spain.
How to link qualifications to the position
Your degree, your experience and the content of the role must be clearly connected. The word “manager” in a job title says nothing about the level of tasks, responsibility or required knowledge. Put together a short professional timeline: periods, companies, functions, supporting documents. A CV helps to get your bearings, but it is not always proof on its own. Experience in place of a degree is usually backed by letters from employers with dates and functions, and by an employment record document from your home country. The UGE lists these documents for the DNV; we have not found a list for the PAC category in public sources.
If the profession is regulated, the immigration permit does not replace the right to practise it: for the Blue Card the law expressly requires homologation [1]. How to get your degree homologated: degree homologation in Spain. The contract, the company letter and the CV must describe the same role. Discrepancies do not always mean a breach, but you will have to explain them, and it is easier to clarify the details before applying than to fix them later in scattered letters.
Offer terms: contract, pay and role
The contract must comply with the law and the applicable convenio colectivo, and the annual gross salary must not be below the threshold for your category [1][2]. Figures do not carry over from one profession to another: the reduced threshold applies only in the cases listed [2]. Allow a margin and check the amount on the day you apply. If your role, pay or employer changes, inform the UGE within 30 days; if the conditions are not met, the permit can be terminated after a hearing [1].
What to check after approval
Read the term and conditions of the permit, the TIE procedure and your obligations when something changes. The law deals with unemployment for the Blue Card separately: the card is withdrawn or not renewed if you are out of work for more than three months (when you have held the card for less than two years) or more than six months (from two years), but this period is given to look for a new job [1]. Family members can apply with you or later under article 62.4 [1]. For family members of Blue Card holders, the regulation provides for an independent permit after five years of residence in the EU, the last two of them in Spain [4].
Common mistakes
- Treating a high salary as the main criterion. You need the category, education or experience, a contract and a salary at or above the threshold [1][2].
- Taking the threshold “from an old article”. It is revised every year; check the UGE figure on the day you apply [2].
- Confusing the Blue Card with the national permit. The conditions on experience, contract and the reduced threshold differ [1][2].
- Skipping homologation for a regulated profession. Without it, the degree is not accepted for the Blue Card [1].
- Different versions of the role in the contract, letter and CV. This is what triggers a requerimiento.
- Not reporting changes. A change of duties, salary or employer must be notified to the UGE within 30 days [1].
When you need an individual review
A review makes sense if you are unsure whether you qualify for the Blue Card or the national permit, if you have to prove experience instead of a degree, if the profession is regulated, if the employer is not yet in the UGE register, if a change of role is planned, or if you are comparing this permit with the DNV or ICT.
