Residence after studying in Spain: work, job search and changing status

A graduate obtains residence after studying in Spain without a visa: the student estancia is switched to an employment permit, a self-employment permit or 24 months to look for work. The application window runs from two months before the estancia ends to three months after; for job search it is 60 and 90 days.

Information material, not an individual legal opinion. Conditions apply to each specific situation and may change.
In brief
  • Switching without a visa is possible from an estancia for higher education, for upper secondary (post-compulsory) education and for certain training programmes, provided you have obtained the diploma or certificate. Language courses are not on this list [1].
  • The application window under article 190.6 of the Regulation as amended by Real Decreto 316/2026 (in force since 16 April 2026): two months before the estancia ends or three months after. An application filed in time extends your existing estancia until the decision [1][2].
  • Once the application is admitted for processing, the estancia becomes a temporary residence and work permit, including full-time work, until the decision; a refusal ends it automatically [1].
  • For job seeking or launching a project you need at least EQF level 6, that is, a bachelor’s degree or higher. The permit is granted for 24 months with no renewal, you cannot work during this period, the decision is made within 20 days, and silence means approval [3][4].
  • If you have already been working for a foreign company with an alta in the Seguridad Social, the UGE allows you to apply for the DNV from an estancia for higher education [6].

What exactly expires and which dates to count

Check three dates: the end of the programme, the date you receive the diploma or certificate, and the end of the estancia. They may not coincide. The estancia remains valid for 15 days after your studies end, and to switch you have to show that you have obtained the diploma or certificate [1]. Ask your institution to explain which document you will receive and when it will be available.

Article 190 of the Regulation (Real Decreto 1155/2024) allows a change of grounds without a visa only for those who held an estancia under 52.1 a) and b) (higher and upper secondary education), 52.1 e) 4º and 5º (training programmes leading to a certificación de aptitud técnica or habilitación profesional, and full certificados profesionales programmes) or for specialised medical training under article 58 [1]. If you only studied a language, this simplified rule does not apply to you. There is one more exclusion: you must not be receiving a grant under Spanish or home-country development or humanitarian aid programmes [1].

Switching to employment or self-employment

For employment, you must meet the requirements of article 74, except the check of the national labour market situation; either the employer or you can file the application, and the fee named in article 190.2 is always paid by the employer [1]. A job offer cannot be replaced by a business plan, nor the other way round: self-employment requires the conditions of article 84 (licences, investment, qualifications); more in the article cuenta propia [1].

In Catalonia, the Generalitat has procedure MOD03a for switching from an estancia to employment: the application is filed by the worker or the employer; under this procedure you pay the work permit fee and the residence permit fee (for residence, using modelo 052) [7].

The initial permit is issued for one year. Renewal and rights follow the usual rules: changing the grounds of your residence permit.

Once the application is admitted for processing, the estancia becomes a temporary residence and work permit, including full-time work, and remains valid until the decision. If the application is refused, it lapses automatically [1]. The new permit takes effect after the alta in the Seguridad Social, and the TIE must be requested within a month of the permit taking effect [1].

Permit to look for work or start a project: 24 months

This is a separate category under additional provision 17 of Ley 14/2013, not a bonus for every graduate. You need a degree of at least EQF level 6 (bachelor’s or higher) obtained at a university [3][4]. You apply online to the Delegación or Subdelegación del Gobierno of the province where you live, within 60 days before the estancia ends or within 90 days after. An application filed in time extends the existing estancia, the decision is made within 20 days, and silence means approval [3][4]. The authority checks the degree, health insurance and sufficient funds based on a declaration; for the applicant alone the benchmark is 100% of IPREM per month [4].

The main restrictions: 24 months with no renewal and no right to work [3][4]. Once you find work or launch a project, you apply for the relevant permit under the general regime or under Ley 14/2013. According to Hoja 20, to avoid the labour market test when you switch to a new permit, you need to have lived in Spain as a resident for at least a year [4]. Do not choose this category just to gain extra time. First understand the restrictions, and if you already have a job, compare it with the article 190 route.

The graduate's family

When switching under article 190, you can also apply for family members who are in Spain under article 56: the conditions are economic sufficiency and suitable housing, and the resulting permit will be for family reunification [1]. When job seeking under additional provision 17, only family members who accompanied you during your studies can stay with you; they do not get the right to work either [3][4]. Extending your stay does not automatically extend your family’s documents under the previous scheme, so keep a calendar for each person. More: a student’s family in Spain.

How to build a transition timeline

  1. Identify your scenario: you already have a job, negotiations are under way, or there is no offer yet.
  2. Write down the key dates: end of the estancia, receipt of the diploma, start and end of the application window.
  3. Check your documents: diploma or certificado, insurance, funds, contract or plan, translations and apostilles.
  4. Apply on time: filing within the window extends the existing estancia until the decision [1][2].
  5. After the decision: alta, TIE, family registration.

Do not wait until the last weeks of your estancia to find out the conditions for changing grounds: you may be left without a suitable route.

Common mistakes

  • Treating a language course or a programme without a diploma as grounds for the switch. Article 190 names specific types of estancia and requires a diploma or certificado [1].
  • Confusing the right to work during studies with the right to work after them. Work on an estancia is allowed as long as it is compatible with your studies; after you finish, you need to change grounds [1].
  • Applying late. The window has limits: the extension of the existing estancia until the decision applies to an application filed within the window [1][2].
  • Choosing job seeking when you already have a job. First compare it with switching under article 190.
  • Not checking grants. Recipients of development programme grants are excluded from article 190 [1].
  • Working during the job-seeking period. This permit does not give the right to work [3][4].

When you need an individual review

A review is worth having if your estancia is about to end and you have no job offer, if you studied on several programmes, if you want to switch to the DNV, if your family is with you or if you had a grant.

Frequently asked questions

Can I keep working on my student permit after I finish?
Not by itself. Work on an estancia for higher education is allowed as long as it is compatible with your studies [1]. Once the programme is over, you need to change grounds. Filing the application in time extends the existing estancia until the decision, and once the application is admitted it works as a temporary work permit [1][2].
Is job seeking available after any language course?
No. Article 190 of the Reglamento does not cover language courses, and additional provision 17 of Ley 14/2013 requires completed higher education of at least EQF level 6 [1][3]. What matters is the degree, not the length of the course.
Can I work on a job-seeking permit?
No. This permit allows you to stay in Spain for up to 24 months with no renewal, but it does not allow you to work [3][4]. Once you find a job, you apply for the relevant permit under LO 4/2000 or Ley 14/2013.
Do I need a contract to apply for a job-seeking permit?
No. The authority checks the level 6 degree, insurance and sufficient funds based on a declaration [3][4]. This differs from the article 190 work permit, which requires a contract or a project.
What if I have missed the application window?
The window: two months before or three months after under article 190.6, and 60 and 90 days for job seeking [1][3]. If it has closed, there are other grounds, but each has its own conditions. Choose a route with a specialist based on your dates.
Can I switch to the DNV after my studies?
The UGE allows you to apply for the DNV from an estancia for higher education if you have had an alta in the Seguridad Social since you started working for the foreign company [6]. The other DNV conditions still apply: the company, a relationship of at least three months, income, insurance.
Do the 2026 Tribunal Supremo rulings affect switching after studies?
The Tribunal Supremo rulings of 8 and 29 July 2026 struck down a number of provisions of the Regulation, including paragraph 2 of article 197, but articles 52-57 and 190-192 are not named in the operative parts [8][9]. The text of article 190.6 was amended by Real Decreto 316/2026 from April 2026 [2]. Check the version in force on the day you apply.
