- One application instead of two: the no lucrativa visa application includes the application for the authorisation. The consulate checks funds and insurance; the oficina de extranjería checks criminal record and any threat to public order (art. 39 and 63 of the Reglamento) [1].
- You apply in person at the consulate for the district where you live. The consulate in Moscow says that applications are accepted by BLS visa centres and that appointments are not given to intermediaries [1][2][3].
- The authority deciding on the authorisation does so within a month of the consulate’s notification; if it stays silent, the application is deemed rejected. After a positive decision the consulate issues the visa within a month [1].
- You must collect the visa within a month of notification, otherwise it is cancelled as if you had waived it. After entering Spain you have one month to apply for the TIE [1].
- If refused, the decision must state its reasons and set out how to appeal: a recurso de reposición to the consulate within 1 month or a court claim within 2 months [2][1].
How a no lucrativa is filed through the consulate: the overall process
Residencia no lucrativa can only be obtained from abroad: a person who wants to live in Spain without working applies for a visa at the consulate, and that application also counts as the application for the authorisation [1]. The Reglamento makes no provision for applying for no lucrativa from within Spain, for example while there as a tourist; see the article residence permit: applying from Spain or through the consulate.
- Identify the consulate for your place of residence and book an appointment.
- Put together the file: forms, passport, funds, insurance, criminal record certificate, medical certificate, fees.
- Submit the application in person and get a receipt with a code.
- Answer any requests from the consulate and, if called, attend an interview.
- Wait for the decision on the authorisation, then on the visa.
- Collect the visa, enter Spain and apply for the TIE within a month.
The law divides the work as follows: the consulate assesses the general visa requirements and those specific to no lucrativa, that is, funds and insurance; the oficina de extranjería checks that there is no commitment not to return, the criminal record and payment of the procedure fee [1].
Step 1. Consulate and appointment to apply
You apply in person at the consulate for the district where you live. This is set out in article 26 of the Reglamento: visas are applied for and collected in person; exceptionally, where there are serious obstacles, this can be done through a representative, and applications can be accepted at an external service centre under contract with the ministry [1].
The exact booking procedure depends on the consulate. The page of the consulate in Moscow, as of 2 October 2026, describes the following: request an appointment by email at least 4 days in advance, with a photo of your face next to your open international passport and your details in Latin letters; one appointment per passport, and each applicant writes separately, children included.
For no lucrativa (RES) the reply contains a link for choosing the date and time. The consulate warns separately that appointments are not given to intermediary agencies and that applicants must apply themselves [3]. The visa page refers residents of the district to BLS application centres; the list of cities in the Russian Federation is published on a separate page [2][4].
The consulate’s two pages, on where applications are accepted and on booking, describe different steps, and we have found no official explanation of how they fit together. Before you start, compare both texts and the latest notices on the website. For citizens of Kazakhstan the procedure is described in the article how citizens of Kazakhstan can apply for a national visa; for Russians and other nationals, the consular district is explained in the article where Russians should apply for a Spanish visa.
Step 2. What documents are needed for a no lucrativa visa?
The list below is taken from the page of the consulate in Moscow; all consulates share the same basis, but each has its own wording and minor requirements [2][1]. Foreign documents are submitted with an apostille or legalisation and a translation into Spanish [2].
| Document | What the consulate in Moscow requires |
|---|---|
| Visa form and form EX-01 | each applicant fills in and signs both forms [2] |
| Photo | recent, in colour, light background, full face [2] |
| Passport | valid for at least a year, two blank pages, issued no more than 10 years ago; Russian citizens also need their internal passport, original and full copy [2] |
| Funds | 400% of IPREM for the applicant and 100% for each family member, for the first year of the authorisation [2][1] |
| Insurance | public or private, with an insurer authorised in Spain, covering all the risks of the public system [2] |
| Criminal record certificate | from the countries of residence for the last 5 years, with translation; from Russia, Belarus, Armenia and Uzbekistan with an apostille [2] |
| Medical certificate | no diseases that endanger public health (International Health Regulations 2005) [2] |
| Residence in the district | for Russian citizens, the internal passport; for others, a passport or residence permit [2] |
| Fees | modelo 790 código 052, item 2.1, in duplicate, plus a consular fee in local currency [2] |
For each family member, documents proving the relationship are added, with translation: birth, marriage or registered partnership certificates [2]. The authorities publish fee amounts separately and change them, so we do not include them in the table; how to pay is explained in the article how to pay the modelo 790 fee. How to calculate funds: financial means for no lucrativa and no lucrativa for pensioners.
Step 3. Filing, requerimiento and interview
After you apply, the consulate returns a stamped copy of the application or sends a confirmation. The consulate in Moscow issues a receipt with a code you can use to check the status on the sutramiteconsular website, plus copies of form EX-01 and the fee receipt [2][1]. The consulate may request additional documents and call you for a personal interview to verify your identity, your documents and the purpose of the application [1][2].
The deadlines are strict. You get 10 days to correct or complete the file when asked; at your request the deadline can be extended, but by no more than 5 days; if you do not reply, you will be deemed to have withdrawn the application (desistimiento). The same goes for an interview summons: you must attend within 15 days at the latest, and failing to attend without good reason leads to the same result [1]. The address and phone number for such notices are given when you apply, so keep an eye on the email in the application. See also requerimiento: how to answer a request for documents and desistimiento and caducidad.
Step 4. Decision deadline and administrative silence
The law separates two decisions. The authority deciding on the authorisation must decide within a month of receiving the consulate’s notification, and if there is no reply within a month, the application is deemed rejected, so for no lucrativa silence is negative [1]. By comparison, for a no lucrativa renewal, silence after three months counts as approval, but that is a different procedure. After a positive decision the consulate issues the visa within a month at the latest [1].
We cannot give the overall time from application to visa based on official sources: the Reglamento sets deadlines for individual stages, not for the whole process, and consulates do not publish statistics. Timeframes for individual consulates reported in blogs vary, and we do not quote them. The principle of how to read deadlines and silence is explained in the article silencio positivo.
Step 5. Visa collected: entry and TIE
You must collect the visa in person within a month of being notified that it has been issued; otherwise you are deemed to have waived it and the file is archived [1]. The consulate in Moscow specifies that no appointment is needed for collection and that the deadline is given in the notice [2]. The visa is valid for 365 days; the law limits its validity to one year [2][1].
With a no lucrativa visa you enter Spain and can live there as a resident, and within one month of entry you apply in person for the TIE [1]. The appointment, fee and fingerprinting in Barcelona are described in the article TIE and huellas. Do not put off empadronamiento (registering your address) either: empadronamiento in Barcelona.
What to do if a no lucrativa is refused, and what did the 2026 rulings change?
A refusal of the authorisation or the visa must state its reasons and set out the ways to appeal, the authority and the deadline [1]. Decisions of consulates and oficinas on visas and authorisations end the administrative procedure, so you can file a reposición, that is, an appeal to the same authority, or go to court [1]. The consulate in Moscow gives the deadlines: reposición within 1 month of the day the refusal is received, a claim before the contentious-administrative court in Madrid within 2 months [2]. Ley 39/2015 allows one month for a decision on a reposición [5]. Details: no lucrativa refusal: grounds and appeals.
The Tribunal Supremo judgments of 8 July 2026 and 29 July 2026 (recurso 21/2025), published in the BOE on 22 September 2026, concern mandatory electronic filing. The court declared void the whole of paragraph 2 of Article 197 of the Reglamento, which listed the cases where individuals must file electronically, including no lucrativa renewal, and in the judgment of 29 July 2026 it repeated that annulment. The court rejected the other arguments about the challenged articles; Articles 61-64 are not on the list of annulled provisions [5][6][7]. How this affects your application depends on the procedure.
Common mistakes when applying for a no lucrativa through the consulate
- Applying in the wrong consular district: the district rule applies under article 26 [1].
- Counting on an appointment through an agency: the consulate in Moscow says appointments are not given to intermediaries [3].
- Bringing a criminal record certificate without an apostille and translation [2].
- Taking out a policy that does not cover all the risks of the public system [2].
- Showing funds without linking them to the household: the threshold goes up by 100% of IPREM for each member [1].
- Missing the deadline to answer a requerimiento: after 10 days without a reply the application is deemed withdrawn [1].
- Not collecting the visa within a month [1].
- Arriving in Spain and forgetting the one month for the TIE [1].
