- 5 days: the maximum time limit for a decision on a NIE application, counted from the date the application enters the register of the competent authority. The decision must also be notified within this period [1][2].
- Silence means refusal. For the NIE the effect is desestimatorio (negative silence), unlike UGE permits for the DNV, where silence counts as consent [1][2][3].
- As a general rule, days in time limits are working days: Saturdays, Sundays and public holidays are not counted [4].
- The NIE is issued without a separate application (de oficio) when a procedure for a document allowing you to stay in Spain has been started [1].
- There are no official figures on how long you actually wait for an appointment. We have not found statistics on NIE processing times.
What deadline does the law set for issuing a NIE?
The law allows five days. Article 205.4 of Real Decreto 1155/2024 provides that an application for a NIE (Número de Identidad de Extranjero, the foreign national’s identification number) is decided within five days of its entry in the register of the authority handling it, and the decision must be notified within the same period [1]. The same time limit is given on the Policía Nacional page on «asignación de NIE a instancia de interesado» [2].
The word «hábiles» does not appear in the text, so the general rule of Ley 39/2015 applies: if a time limit is set in days and the law does not say otherwise, the days are working days, excluding Saturdays, Sundays and public holidays [4]. Five days is about one working week. The period runs from the date the application enters the register, not from the date you booked an appointment.
What happens if there is no answer within 5 days?
By default the application is deemed rejected. Article 205.4 states that once the time limit expires without a reply, the application «se entenderá desestimada» [1]. The police website repeats this: the effect of no decision within the time limit is desestimatorio [2].
This is where it differs from the UGE. Under Ley 14/2013, for permits handled by the UGE, silence after 20 days means consent (silencio positivo) [3]. For the NIE the opposite rule applies. Under article 24 of Ley 39/2015, negative silence only gives you the right to appeal [4]. The police name two routes: a recurso de reposición within 1 month and a claim before the contencioso-administrativo courts within 2 months [2]. Which option suits your case is for a lawyer to decide: we do not know your situation. The general logic of administrative silence is explained in the article silencio positivo.
When is a NIE issued without a separate application?
The NIE is assigned by the Dirección General de la Policía on its own initiative (de oficio) if a procedure has been started for you for a document entitling you to be in Spain. This follows from article 205.3 of Real Decreto 1155/2024. For visas, this rule applies when the visa allows you to stay in the country for longer than 90 days within 180 [1].
A separate NIE application is filed by people who have economic, professional or social interests in Spain but are not applying for a permit. There are two conditions: no illegal stay, and the application must state why the number is needed [1][2]. For more on the difference between the documents, see the article NIE, TIE and residence permit, and how to get the number in Barcelona is described in NIE in Barcelona step by step.
What makes up the real waiting time?
The official five days start only once the application has been accepted, and most of the time is usually taken up by getting an appointment. The steps are:
- Book an appointment (cita previa) at the office or police station where you are submitting the application.
- Pay the modelo 790 código 012 fee. The line «Asignación de NIE a instancia del interesado» costs €9.84 as at 2 October 2026 [5][6].
- Submit the EX15 form and proof of payment in person or through a representative [2].
- Decision within five days [1].
Official sources do not publish how long the first step takes in Barcelona, and we have not found statistics on the NIE. Available appointments change quickly, so giving an average would be pure invention. If you are applying from abroad, the NIE application is submitted through a Spanish consulate [1][2]. How to book is described in the article on cita previa at extranjería.
What depends on your case?
The time limit and procedure depend on how you obtain the number: de oficio together with a permit, on application in Spain, or through a consulate. This also determines whether you need a separate appointment. If you need a NIE for a bank or to buy a home and are not applying for a residence permit, a separate application stating the reason is the right route.
If you are applying for a residence permit, the number will usually come through the procedure itself, and there is no need to rush a separate NIE. Check the exact choice with a lawyer or gestor. What the cost of the number includes is described in the article how much a NIE costs, and the team handles document preparation as part of the document service; the general procedure for each residence permit route is on the residence permit in Barcelona page.
