Non-lucrative residence

Can You Work on No Lucrativa? Restrictions and the Legal Route

You cannot work on no lucrativa: not as an employee in Spain, not self-employed and not remotely for a foreign company. You can only start working with a separate permit, and after a year of residence the conditions are less strict.

Information material, not an individual legal opinion. Conditions apply to each specific situation and may change.
In brief
  • No lucrativa means living in Spain without any work or professional activity (Art. 61 Reglamento). Any paid activity requires a prior work permit (Art. 36 Ley Orgánica 4/2000) [1][2].
  • The UGE states plainly that no lucrativa does not give you the right to work, including remotely, and that working without a permit breaks the immigration law (section III) [3].
  • The permit can be withdrawn if it is used for a purpose other than the one it was granted for, or if you stop meeting the conditions. At renewal, the authorities take into account whether you have met your tax and Seguridad Social obligations [1].
  • The route to work: from no lucrativa you can switch to an employee work permit or to self-employment. After one year of residence, the switch is possible without a labour market test; before one year, only with such a test (Art. 191 Reglamento) [1].
  • Income from rent, interest and dividends is not work in itself, but if you personally run the business, where the line falls has to be assessed separately [1].

Can you work on a no lucrativa?

No. The Reglamento defines no lucrativa as the status of a person who is allowed to live in Spain without any work or professional activity [1]. The immigration law adds a general rule: any foreign national over 16 needs a prior residence and work permit for any paid, employed or professional activity [2]. No lucrativa holders have no such right.

We found no exceptions in the text of articles 61-64 for small earnings, for working “a couple of hours” or for temporary projects [1]. The restriction does not depend on where the employer is based or where the payment comes from. The Ministry of Inclusion says it directly in the UGE guidance: no lucrativa does not allow you to work, so you cannot rely on remote work you did earlier, and working without a permit breaks the law [3].

What counts as work and what doesn't?

The law speaks of “lucrativa, laboral o profesional” activity, that is, paid, employed and professional activity. On that basis we look at typical cases below, but each one needs an individual assessment:

SituationConclusion from the text of the law
Employment in Spainnot allowed without a work permit [1][2]
Your own business, autónomo, clients in Spainnot allowed without a self-employment permit (Art. 84 Reglamento) [1]
Remote work for a foreign companyno lucrativa does not allow it; there is a separate teletrabajo permit for that [3][4]
Renting out a flat, interest, dividendsnot work in themselves, but if you hold a stake in a company you need a statement that you do not work in it [1]
Study, language coursesnot work; a paid internship still counts as work

The row on rent and dividends needs explaining. Article 62 expressly covers the case where the funds come from shares or holdings in a Spanish, mixed or foreign company located in Spain: the applicant must confirm that they carry out no work activity in it and submit a declaration to that effect [1]. For someone who runs the company personally, this means no lucrativa is not suitable, even if the money formally comes as dividends. For working under a different status, see the comparison table of grounds.

What do you risk by working on a no lucrativa?

The consequences come in several layers. We list only those confirmed by the text of the law and point out where their exact legal classification is unclear.

  • Withdrawal of the permit. The Reglamento provides for the permit to end if it is used for purposes other than those it was granted for, or if the conditions are no longer met [1].
  • Renewal. At renewal, the authorities may take into account breaches of tax and Seguridad Social obligations during the period of the permit [1]; the reasons that lead to refusal are covered in the article no lucrativa refusal.
  • Fine. For self-employed work without a permit by someone who holds a residence permit, the immigration law classes the offence as minor, with a fine of up to €500 [2]. For employed work, the law separates cases by whether the person holds a valid residence permit, and we did not find in the provisions we reviewed which classification applies to a resident without the right to work; the fine for a serious offence is €501 to 10,000 [2].
  • The employer. Hiring a foreign national without a prior residence and work permit is a very serious offence, with a fine of €10,001 to 100,000 per worker [2]. That is the employer’s liability, but it is directly linked to your position.
  • Future plans. The UGE calls work without a permit an offence and does not accept such work as grounds for a teletrabajo permit [3].

How to start working legally after a no lucrativa?

You can work under a different permit, and the law allows the switch without a visa if you are in Spain with temporary residence status. Article 191 of the Reglamento separates two cases: less than one year of residence, and one year or more [1].

RouteConditionsOutcome
Employment, less than one year of residenceall the requirements of Art. 74, including the labour market situation [1]one-year permit
Employment, one year or moreArt. 74 without the labour market requirement [1]one-year permit, effective once you register (alta) with Seguridad Social within one month [1]
Self-employment, one year or moreArt. 84 requirements: authorisation to carry out the activity, qualifications, investment [1]one-year permit [1]
Remote work for a foreign companyteletrabajo permit under Ley 14/2013; on no lucrativa, the UGE answers “no” [3][4]separate review

The application can be filed by the employer or by the resident [1]. The employer requirements are the same as in Article 74: a contract for continuous work, compliance with the law and the collective agreement, no debts to the tax authorities or Seguridad Social, and the means to pay the salary [1]. More on this: residence permit through an employment contract and how an employer hires a foreign national. On self-employment: cuenta propia. The general procedure for switching: can you change the grounds of your residence permit.

There are two caveats. First: until the decision, you still live under no lucrativa and are not allowed to work, because the new authorisation only takes effect with your alta in Seguridad Social. Second: the switch does not replace the no lucrativa renewal if you decide to stay in that status, and the 183 days of residence condition is still checked at renewal [1].

What is allowed on a no lucrativa and what obligations remain?

You can live in Spain, manage your capital, receive a pension and income from assets, and study. But the regime has its own obligations, and they are checked too. At renewal you need to prove funds for the new period, insurance that covered the whole previous period, school for children of school age, payment of the fee and actual residence in Spain for more than 183 days in the calendar year [1]. Tax residence is determined separately, and if you live in Spain for more than 183 days you are a Spanish taxpayer on income from any country; check this with a gestor in advance. More on preparation: no lucrativa renewal and can you study on no lucrativa.

Typical “grey” situations and why they are risky

  • “A little side work for my former employer.” The amount does not matter: the UGE treats any work without a permit as an offence [3].
  • Payment goes to a spouse or a company. The law looks at who carries out the activity, not who receives the money; we advise you not to build your plans on this.
  • A salary renamed “dividends” or “consulting”. Article 62 requires separate confirmation that you do not work in the company the money comes from [1].
  • Freelancing for Spanish clients. This is self-employment, and it requires a permit under Article 84 [1].
  • The thought “I’ll apply for a DNV later with a history of remote work”. The UGE answers that work done on no lucrativa cannot be cited as grounds [3].

If you are already in one of these situations, do not delete documents and do not rush into any steps: an assessment and a plan of action should come from a lawyer who looks at your case.

Frequently asked questions

Can I work remotely if I have no lucrativa?
No. The UGE writes that no lucrativa does not allow you to work, so you cannot do remote work and cannot cite it as grounds for a teletrabajo permit. For remote work for a foreign company there is a separate permit under Ley 14/2013 [3][4].
Can I earn income from renting out a flat on no lucrativa?
Income from property is not work in itself. What matters is that you do not run an activity personally and that you can prove where the funds come from [1]. If it is a business in Spain, it needs a separate assessment: renting as a business activity may require a permit.
What happens if I am caught working on no lucrativa?
The immigration law classes work without a permit as an offence and provides fines for it, and the permit can be ended if it is not used for its purpose. The authorities decide the classification based on the circumstances of the case [1][2].
When can I switch from no lucrativa to a work permit?
Straight away, but if you have lived in Spain for less than one year, the employer has to pass the labour market test. From one year of residence the requirements are lighter: you need the Art. 74 conditions without that test. The decision takes time, and you cannot work until it is issued [1].
Can I register as autónomo while on no lucrativa?
Only after you obtain a self-employment permit under Art. 84 of the Reglamento. After one year of residence you can apply for it without a visa. Registering the activity without a permit does not give you the right to work [1].
Can a spouse and children on no lucrativa work?
No. Article 61 defines no lucrativa as residence of the applicant and their family without any work or professional activity, so the restriction also applies to family members. They need their own work permits [1].
