- Arraigo de segunda oportunidad (article 127.a of the Reglamento) requires that in the two years before you apply you held a residence permit not granted on exceptional grounds, and that it was not renewed for reasons other than public order, security or public health [1].
- SEM instruction 1/2025 clarifies that the permit must have been renewable, and that this route is open if you missed the deadline for filing the renewal or were refused because you did not meet the requirements. If the permit ended through extinción (other than by expiry), this type is not available [3].
- An exception for public order and security reasons: you can apply if there is a dismissal of the charges, a discontinuance of the case or an acquittal [1].
- The general conditions still apply: two years of continuous stay before you apply, no criminal record and, from 16 April 2026, no other permit or procedure for one (letter h of article 126) [1][2].
- The permit is issued for one year and includes the right to work as an employee and as self-employed. To renew it, you need to be actively looking for work and registered with the employment service [1][2].
What arraigo de segunda oportunidad is and why it was introduced
Arraigo de segunda oportunidad is one of the five types of arraigo. It was introduced in the Reglamento de Extranjería (Real Decreto 1155/2024) as a new “second chance” for people who lost their legal status but stayed in Spain [1][3]. Legal basis: article 127.a. General overview of all types: types of arraigo in Spain.
The logic is simple. A person has already passed the state’s checks, obtained an ordinary residence permit and then could not renew it: they missed the deadline, their income fell short, their employer left. Instead of starting again “from zero”, they get a chance to obtain a new permit, provided there are no public order, security or health issues.
Who it is for: what counts as a previous permit
Article 127.a requires that you held a residence permit not granted on exceptional grounds during the two years immediately before you apply, and that it was not renewed for reasons other than public order, security or public health [1]. SEM instruction 1/2025 adds two clarifications [3]. First: the permit must have been renewable. Second: this type is available if the renewal failed because the filing deadline passed or because it was refused for not meeting the requirements.
| Your situation | Eligible? |
|---|---|
| A residence permit (no lucrativa, employment, family reunification and so on) expired and the renewal was not filed in time [3] | Yes, if the other conditions are met |
| The renewal was refused because the requirements were not met, for example income or employment [3] | Yes, if the other conditions are met |
| Not renewed for reasons of public order, security or public health [1] | No, except where there was a dismissal of the charges, a discontinuance of the case or an acquittal [1] |
| The permit ended through extinción: fraud, use for a different purpose, loss of the requirements, etc. (article 200), other than ordinary expiry [3][1] | No, under the instruction |
| The previous permit was granted on exceptional grounds, including arraigo [1] | No |
| The previous stay was for study (estancia por estudios) [1] | Open question: the article refers to a residence permit |
The last row is debatable. Under the Reglamento, estancia por estudios is an “autorización de estancia”, not “de residencia”, and we found no official guidance on how the ministry treats such cases. Check this with a legal professional before you apply [1].
How to count the two years and when to apply in time
There are two time frames here, and this is where mistakes happen most often. First: you must have held the previous permit during the two years before you apply [1]. Second: the general condition of article 126.b, two years of continuous stay in Spain before you apply [1]. Years with the previous permit count as years of stay, but the absence limit applies to them too: the ministry reads “continuously” as no more than 90 days of absence over two years [3][4]. We found no official guidance on how the oficina combines the two checks.
Count the window backwards from the filing date and note the date your previous permit ended. The later you apply, the less is left of the “two years with a permit”. More on counting your stay: how many years you need to live in Spain for arraigo.
Point h of Article 126: you cannot apply while a renewal is pending
From 16 April 2026 you cannot apply for arraigo if you hold a stay or residence permit or are involved in a procedure to grant, renew or modify one [1][2]. For segunda oportunidad this is the main practical question. A renewal can usually be filed from two months before expiry and up to three months after it, and filing extends the old permit until the decision [1]. While you are within that window and can still file a renewal, you first have to choose: renew or switch to arraigo.
If you are currently challenging a refused renewal, do not drop the appeal just for a programme with a new name. How letter h relates to a pending recurso has not been officially explained, and this must not be decided without a legal professional. How to appeal: reposición, alzada and the courts; first steps after a refusal: residence permit refusal in Spain.
Which documents to gather
According to the ministry’s information sheet, you file [4]: the EX-10 form, a full copy of your passport, proof of two years of stay in Spain, and criminal record certificates from the countries where you lived during the five years before entering Spain, apostilled and sworn-translated [4][5]. If you have lived in Spain for the last five consecutive years, certificates from third countries are not needed [1].
The sheet does not name a separate document on the previous permit. In practice it makes sense to attach the decision granting it, both sides of the card, the renewal receipts and the refusal with proof of the notification date: they explain why the renewal did not happen. We have not established what the oficina checks in its own records and what it will ask you for. How to gather proof of stay: proof of residence. If you have only just realised that the renewal deadline has passed, see expired residence permit: what to do.
Step-by-step procedure
- Put together a timeline: when the previous permit was granted, when it ended, what you filed and what you received [1][3].
- Check that no procedure for another permit is open (letter h) and whether the renewal window is still open [2].
- Check why you lost your status: deadline, refusal on requirements, extinción, public order [3].
- Order criminal record certificates with apostille and translation, and gather proof of stay and a table of your trips abroad over the two years.
- File the EX-10 with the oficina de extranjería of your province or electronically through Mercurio. Under article 130.1 the foreign national files the application in person; filing through a representative is possible under article 197.4 (a notarised power of attorney or an apud acta power in the electronic register, or through members of a convenio or the Registro de Colaboradores); whether you need one in your case is for a lawyer to decide [1]. The fee under modelo 790, código 052, is paid at the time of filing if you file electronically, or within ten working days if you file in person [4][7].
- Reply to a requerimiento within the deadline of up to 15 days, otherwise you will be treated as having withdrawn. The Reglamento sets no deadline for the decision; the ministry’s information sheets give three months and treat silence as a refusal [4]. After approval, apply for the TIE in person within one month [1][4].
What the permit gives you and what happens after a year
The permit is issued for one year. It gives you the right to work as an employee and as self-employed in any occupation and in any region [1][4]. After a year you can renew it if you prove active job seeking and registration with the employment service (with an exception for illness, disability and retirement age) [1][2]. Alternatively, you can switch to a residence and work permit under article 191: the ministry names this option at the end of segunda oportunidad [4][1]. Which to choose depends on your contract, income and family.
Common mistakes
- Calling everything an “overstay”. For this type, the reason and the documents matter: a missed deadline, a refusal on requirements, extinción and public order or security issues are different cases [3].
- Throwing away old papers. The decision, the card and the receipts explain why the renewal did not happen.
- Applying while a renewal is pending. This is an obstacle under letter h [2].
- Treating a student card as the previous permit. Estancia and residencia are different; the question needs to be checked [1].
- Dropping the recurso. The consequences of withdrawing an appeal should be assessed with a legal professional in advance.
- Not counting absences. More than 90 days over two years calls continuity into question [3].
When you need an individual review
Almost always. The reason you lost your status, the renewal window, a pending recurso, absences, entries on certificates and removal proceedings all change the picture. We do not give opinions on specific cases: check with a lawyer before you apply, especially if you are unsure whether your previous permit qualifies. The 2026 Tribunal Supremo rulings did not affect article 127.a [6].
