Renting a Room or a Flat in Barcelona: Which to Choose

A room is rented from the owner or from the main tenant, a whole flat under a contract with the owner. The difference lies in protection: a room rented from a tenant depends on that tenant's contract, and since 01.01.2026 Catalonia links the total rent for rooms to the cap for the whole flat.

In brief
  • In Catalonia, a room is a housing rental: Llei 11/2025 (in force since 01.01.2026) states explicitly that dividing a flat into rooms does not set aside the rules on housing rentals [1].
  • In a mercat residencial tensionat zone, which includes Barcelona, the total rent under simultaneous contracts for rooms in the same flat cannot exceed the maximum for the whole flat [1][4].
  • If you rent a room from a tenant, that tenant needs the owner’s written consent to sublet, the sublet price cannot be higher than the main rent, and your right ends when their contract ends [2].
  • Under the LAU, the tenant of a flat may move out after 6 months with 30 days’ notice, and the deposit (fianza en metálico) is set by law at one month’s rent [2].
  • If the contract does not state that it is temporary, it is treated as a contract for a permanent home [1].

How does a room contract differ from a flat contract?

Under Llei 11/2025, which amended the Catalan Right to Housing Act, Llei 18/2007, a room rental is a contract under which the owner gives the tenant exclusive use of a room and the right to use the shared areas in exchange for payment. The law adds two conditions: the floor area per person and the maximum number of occupants must not breach the limits in the cédula de habitabilidad (the certificate that the dwelling is fit to live in), and dividing a home into rooms does not set aside the rules on housing rentals [1].

A contract for a whole flat is governed by the LAU (Ley 29/1994 on Urban Leases). The Catalan legislature classes room contracts as housing rentals, but we have not found any official guidance on how this regime fits with the national LAU on duration and renewal.

What changes if the room is not let by the owner?

In that case it is a sublet (subarriendo). Article 8 of the LAU only allows part of a home to be sublet, and only with the landlord’s prior written consent. The sublet price cannot exceed the main rent, and the subtenant’s right ends when the main tenant’s right ends [2]. Subletting without the owner’s consent is also one of the grounds on which the owner may terminate the main contract [2].

Before you pay, ask to see the owner’s written consent or the contract with the owner.

Barcelona is on the list of municipalities declared tensionado zones under resolution TER/800/2024 [4]. The cap applies while the declaración is in force: the Generalitat states that it is issued for three years and extended annually [5].

Which rules protect a flat tenant?

The LAU leaves the term open, but if it is shorter than 5 years (7 years if the landlord is a company), the contract renews every year until that minimum is reached unless the tenant gives notice 30 days before the end [2]. The tenant may leave after 6 months with 30 days’ notice, and the contract may provide for compensation for leaving early [2]. The deposit (fianza en metálico) is one month’s rent, any additional guarantee in a contract of up to 5 years cannot exceed two months’ rent, and agency and contract costs are paid by the landlord [2].

In tensionado zones, a new rent cannot exceed the last rent of the previous 5 years, updated by indexation. If the flat has not been let in the last 5 years, the maximum under the reference index applies [5]. The landlord must deposit the fianza with Incasòl within two months of signing [6].

What should you choose at the start?

There is no single answer, and we found no official statistics on room prices. For flats, the Generalitat publishes data: the average rent under housing contracts in Barcelona in the first quarter of 2026 was €1,137.35 a month. This is the average of contracts deposited with Incasòl, not the price in listings [7].

If you need a home for a few months, keep the Llei 11/2025 rule in mind: a temporary contract states the reason (work, study, waiting for a home) and attaches proof. If the purpose is not stated, the contract is treated as a permanent housing contract [1]. Since 01.01.2026, Incasòl asks for a document proving the purpose to be attached to temporary contracts [6]. From 08.10.2026, Article 9 bis LAU (Real Decreto-ley 29/2026) also covers room rentals: a temporary contract needs a genuine reason, and its term must be longer than 31 days and, as a rule, no longer than 12 months [8].

What suits you depends on the length of stay, your budget and how many people are moving. The team’s lawyer at ReloVictory reviews contracts individually at a consultation. Frequently asked questions

Can you rent a room in Barcelona without a written contract?
The law allows a verbal housing rental contract, and payment records help prove it. Even so, the Generalitat recommends a written contract, as it makes it easier to prove breaches by either party. Put the room terms, the number of occupants and the payment arrangements in writing [3].
Do you need the owner’s consent to rent a room from a tenant?
Yes. Under Article 8 of the LAU, subletting part of a home is only allowed with the landlord’s prior written consent. Without it, the owner may terminate the main contract, and your right depends on that contract. Ask to see the consent or the contract with the owner before you pay [2].
Can a room in Barcelona be let at any price?
In a tensionado zone, which includes Barcelona, the total payments under simultaneous contracts for rooms in the same flat cannot exceed the maximum for the whole flat. In a sublet, the price cannot be higher than the main rent [1][2][4].
What deposit do you pay when renting a room in Catalonia?
For a housing rental under the LAU, the deposit (fianza en metálico) is one month’s rent, and the landlord deposits it with Incasòl. Whether this applies to a particular room contract, check in the contract itself and with a lawyer: we found no guidance specific to rooms [2][6].
Can you move out before the end of the term?
A housing tenant may leave after 6 months by giving the landlord 30 days’ notice. The contract may provide for compensation of one month’s rent for each remaining year. For a room, check the terms in your contract [2].
Does the number of occupants affect room rentals?
Yes. Llei 11/2025 requires compliance with the floor area per person and the maximum number of occupants stated in the cédula de habitabilidad. Ask for the cédula and compare the number of occupants with the contract and with the number of people actually living there [1].
