- Under the LAU, a residential tenancy meets a permanent housing need, while a seasonal let is classed as a tenancy for other use (Articles 2 and 3). In Catalonia, from 2026 the purpose of the contract is what counts [1][2].
- Housing: a contract shorter than five years (seven if the landlord is a company) is extended year by year up to that minimum. Deposit: one month’s rent [1].
- A seasonal contract is governed by the parties’ agreement, Título III of the LAU and the Código Civil. Deposit: two months’ rent [1].
- Catalonia’s Ley 11/2025 (from 1 January 2026): a housing contract is permanent regardless of its term, and a temporary one for work, study or medical treatment is subject to the housing rules on deposit, guarantees and rent [2].
- The articles of Ley 11/2025 on temporary contracts have been challenged before the Constitutional Court [6]. From 08.10.2026, under Real Decreto-ley 29/2026, a temporary housing contract (new Article 9 bis LAU) needs a genuine reason, and its term must be longer than 31 days and, as a rule, no longer than 12 months [9].
How does the law distinguish long-term and seasonal rentals?
The Ley de Arrendamientos Urbanos (LAU, Ley 29/1994) distinguishes two regimes. A residential tenancy is the letting of a building that is fit to live in and whose main purpose is to meet the tenant’s permanent housing need (Article 2). A tenancy for other use is one with a different main purpose; the law expressly names seasonal lets, whether for summer or any other season, and business lets (Article 3) [1].
All contracts are subject to the mandatory Títulos I and IV. Beyond that, housing is governed by the parties’ agreement within the limits of Título II, while other use is governed by the parties’ agreement, then Título III and the Código Civil (Article 4) [1]. In a seasonal contract the parties have more freedom over the term and conditions, and the tenant has fewer guarantees.
What rules apply to a long-term lease?
The parties set the term themselves. If it is shorter than five years (seven if the landlord is a company), the contract is extended year by year up to that minimum unless the tenant gives 30 days’ notice of leaving (Article 9). After the minimum, it is extended year by year for up to three more years unless the parties have given each other notice in advance (Article 10). The tenant may terminate the contract after six months by giving 30 days’ notice (Article 11). The deposit (fianza) is one month’s rent, and an additional guarantee on a contract of up to five years may not exceed two months’ rent (Article 36) [1]. The deposit is lodged with INCASÒL [3].
In a stressed housing market area, the rent under a new contract must not exceed the last rent paid in the previous five years, adjusted for indexation; if the home has not been let for five years, a cap based on the price index applies [3]. Barcelona is on the list of these municipalities [7].
What has changed for seasonal leases in Catalonia?
Catalonia’s Ley 11/2025, in force since 1 January 2026, added Article 66 bis to Ley 18/2007. A residential tenancy is considered permanent if it meets a housing need, regardless of its term. Lets for leisure, tourism and holidays are not considered residential tenancies [2].
A contract concluded for a limited time because of work, study, medical treatment, waiting for a home or similar reasons is subject to the housing rules on deposit, guarantees, setting and updating the rent, rent increases for improvements, and expenses [2]. The purpose is stated in the contract, backed by documents, and these are filed with the register together with the deposit. Without proof, the let is presumed to be a permanent home [2].
If the contract is extended without a documented reason, the rules for permanent housing apply, with the term counted from the original contract. The same applies to a new contract with the same tenant for the same flat, unless the landlord proves that the reasons still exist [2].
How do the three regimes compare?
| Feature | Permanent home | Temporary contract for work or study | Leisure and holidays |
|---|---|---|---|
| Legal basis | LAU, Título II | Ley 18/2007, Art. 66 bis, para. 2 [2] | LAU, Título III; Art. 66 bis, para. 4 [1][2] |
| Minimum term | 5 years, 7 for a company [1] | The minimum term is not among the housing rules that Article 66 bis applies to these contracts; if the contract is extended without proof, the housing rules apply [2] | As per contract [1] |
| Deposit | 1 month’s rent [1] | Under the housing rules [2] | 2 months’ rent [1] |
| Rent cap | Applies in a stressed market area [3] | Under the housing rules on rent [2] | Housing rules on rent do not apply [2] |
Is Llei 11/2020 still in force and what is being challenged in 2026?
Llei 11/2020 on rent containment still appears in listings, but the Constitutional Court in Sentencia 37/2022 struck down its Articles 1, 6-13, 15 and 16.2 and several additional provisions [5]. Today the rent cap rests on Ley 12/2023 and Catalan legislation, including Decret llei 1/2025, which introduced liability for using a temporary contract to get around the rules [4][8].
Paragraphs 5 and 6 of Article 5 of Ley 11/2025 (temporary contracts and rooms) have been challenged before the Constitutional Court by a group of members of parliament; the challenge was admitted on 9 June 2026 [6]. We found no information on these paragraphs being suspended, but check their status before you sign.
Could the rules on temporary rentals change?
Article 9 bis LAU has applied since 08.10.2026. If a temporary contract lasts more than 12 months without grounds, or the parties have signed more than two temporary contracts in a row for the same home, the first is treated as a permanent housing contract with the terms of Articles 9 and 10 LAU; a tenant on a temporary contract can leave after one month by giving at least 10 days’ notice [9]. “Por temporada” contracts signed before 08.10.2026 keep the old rules until the end of their term and then end without renewal [9]. The articles of Ley 11/2025 on temporary contracts have been challenged before the Constitutional Court [6], so before you sign, check the current wording of Article 66 bis of Ley 18/2007 [2].
What depends on the case?
The purpose of the contract, the documents supporting it and the registration of the deposit differ from case to case. We do not know how the Ajuntament and the courts apply Article 66 bis in practice. A contract called seasonal may turn out to be a housing contract with all its guarantees, so show it to a lawyer before you sign.
