- You can rent a flat through a listings portal, an agency or directly from the owner: the Generalitat states plainly that every step can be done with the owner, without an intermediary [1].
- In a tensionado zone, which includes Barcelona, the listing and the contract must show the last rent of the past 5 years or the price under the reference index, and the gran tenedor status; Catalonia classes the absence of this information in advertising as a serious infringement [4][10].
- Agency and contract preparation costs are paid by the landlord (LAU, art. 20.1). The deposit equals one month’s rent, and the landlord lodges it with Incasòl within two months [5][9].
- Agencies in Catalonia must be entered in the mandatory Registro de agentes inmobiliarios; nothing replaces your own inspection of the property and checking the owner [8].
- Signs of fraud according to INCIBE: a price well below the market, photos taken from other listings, “the owner is abroad”, pressure to hurry, payments through money transfer services [6].
How to rent a flat in Barcelona: the search step by step
- Budget. The Generalitat advises that monthly rent should not exceed a third of your income, and that you factor in water, electricity, gas, comunidad and IBI if they are passed on to the tenant [2].
- Area and type of home. An unfurnished flat, according to the Generalitat, is usually 10-15% cheaper, but you will need furniture and to connect the utilities. In a furnished one, check the appliances and installations [1].
- Searching for listings. A portal, an agency or the owner directly. The channels are below.
- Checking the listing. Does it show the price under the tensionado zone rules and the owner’s status, are the photos reused elsewhere, does the address exist [4][6].
- Viewing. Condition of the home, documents, figures. See the section on viewings.
- Checking the owner. The Registro de la Propiedad shows who owns the property, and a representative must hold a formal authorisation (poder) [14]. How to order the extract: nota simple online.
- Contract. The information the law requires, the term, the deposit, the purpose of the tenancy [3][4].
- Deposit. The landlord lodges it with Incasòl within two months of signing and receives a registration number [9].
- Empadronamiento and utilities. See registering your address and connecting utilities.
Where to look for a flat: the channels available
We do not recommend specific platforms: the choice is yours. The channels differ, but what you need to check is the same.
| Channel | What to check | How to check it |
|---|---|---|
| Listings portal | Price, owner’s status, reused photos, address | Tensionado zone rules, signs of fraud [4][6] |
| Agency or property manager | Whether it is on the register, who pays the fee | Registro de agentes inmobiliarios de Cataluña, LAU art. 20.1 [8][5] |
| Owner directly | Owner according to the register, cédula, energy certificate | Registro de la Propiedad, owner’s documents [14] |
| Acquaintances, chats, social media | The same information, plus whether the account is genuine | INCIBE signs of fraud [6] |
The Registro de agentes inmobiliarios de Cataluña is public and mandatory for anyone who provides intermediary services for rentals and sales on a regular basis. Administradores de fincas acting only in their own capacity, and intermediaries with no regular activity and no payment, are not included [8]. According to the Generalitat, property managers usually charge around one month’s rent, but under the LAU agency and contract preparation costs fall on the landlord, and you are entitled to ask on what basis you are paying [2][5].
What must the listing and the contract include in a zona tensionada?
Barcelona is in the mercat residencial tensionat zones, where a cap on new rents applies [10]. Under Decreto ley 1/2025, the minimum information in a rental offer includes the last rent of the past 5 years for that flat or the price under the reference index with a supporting document, and the owner’s status as gran tenedor. The absence of this information in advertising is classed as a serious infringement [4].
A contract in such a zone must show the same information and the purpose of the tenancy. On signing, the tenant is entitled to receive the document on the price under the reference system, the cédula de habitabilidad and, where applicable, the energy certificate [4][3]. The reference index applies if the home has not been let for 5 years or the owner is a gran tenedor, and it cannot be exceeded [10]. The Generalitat page on the price cap links to the Ministry of Housing calculator [15]. Check the actual price of the home in your case with a lawyer.
What should you look at when viewing a flat?
The Generalitat advises paying attention to the general condition and how well the home suits your needs: ventilation of the rooms, natural light, space, access to transport. In a furnished flat, check the washing machine, fridge, cooker and water heater, the water, gas and electricity systems and, in older buildings, the water pressure [2][1]. We would add that it is worth photographing the condition of the home and drawing up an inventory when you sign.
Ask the owner to show you the cédula de habitabilidad, without which the home cannot be offered for rent, and the comunidad’s rules [2]. The landlord is required to give the tenant the energy certificate [14]. A furnished flat needs an inventory of furniture and appliances signed by both parties [3].
If the flat is offered “for a season”, look at the purpose stated in the contract. Llei 11/2025 requires the purpose of a temporary contract to be stated with supporting evidence attached; without it, the home is presumed to be a permanent residence [13]. The law is being challenged, so check its status before you sign.
How do you check the owner and the listing?
- Owner. Order a nota simple and compare the name with the person signing. If someone else acts on the owner’s behalf, check their notarised authorisation (poder notarial) [14].
- Photos and address. INCIBE advises checking the images with a reverse image search and confirming on Street View that the building exists [6].
- Contacts. An “agency” using an email on a free domain, an owner who cannot show the home and who suggests paying through intermediaries: these are warning signs [6].
- Price. Compare with similar listings in the area: a noticeably low price is a reason to be cautious [6].
- Tourist flat. The Ayuntamiento advises checking the address against the register of legal tourist flats on the city’s website. If you are told not to open the door to an inspector or to call the owner a “friend”, that is a sign of an illegal let [7].
What details are safe to share before a viewing?
Reglamento (UE) 2016/679 requires the data requested to be limited to what is necessary (art. 5.1.c, the data minimisation principle) [12]. So do not send your passport and bank statements in reply to every listing. A general description is enough: how many of you there are, for how long, what income you have. Full documents are shown once you have checked the owner and the flat. More on which documents to show instead of a nómina: renting in Barcelona without a nómina.
What are the most common signs of fraud?
| Sign | What it means |
|---|---|
| Price far below the market | Bait: after you reply, they ask for money |
| Photos with watermarks or from other listings | The listing has been copied |
| “The owner is abroad”, no viewing possible | They ask for payment through intermediaries or a “booking service” |
| Email address on a free domain | Impersonating an agency |
| Pressure to hurry and “lots of interest” | Aim: to make you pay before checking |
| They agree to any terms | No interest in the tenant, only in the money |
| They ask for MoneyGram, Western Union and the like | No way of getting the money back |
Source of the list: INCIBE [6]. If you have already paid, contact your bank and the police immediately. We cannot promise you will get your money back: the outcome depends on the circumstances and on what the police do. We do not assess individual fraud schemes; each has its own circumstances.
Which flat-hunting mistakes cost the most?
- Transferring money “for a reservation” before the viewing and before checking the owner [6].
- Paying an agency fee that, under the LAU, the owner pays [5].
- Signing a contract with no purpose stated or no information on the last rent in a tensionado zone [4][13].
- Paying the deposit in cash with no receipt and without it being lodged with Incasòl [9].
- Agreeing to a “temporary” contract because the owner suggested it: the purpose must be genuine and supported by evidence [13].
- Skipping the viewing because of distance: if you are abroad, arrange a video viewing and a trusted representative, not a blind payment.
- Skipping empadronamiento after moving in: it requires the contract and documents, see the article on registration.
When do you need an individual review?
If you are offered non-standard terms, a term of less than 5 years, payment in advance, a contract through a third party or a room rental, it makes sense to show the contract to a specialist before signing. It depends on your case, so we do not give template answers. If you are still choosing between renting and buying, see renting or buying in Barcelona. On the contract in general: what to look at before signing, and on rooms: flat or room.
