Nomad vs autónomo in Spain: DNV or cuenta propia

Nomad vs autónomo in Spain is a choice between two residence permits: the DNV (Ley 14/2013) for working for foreign companies and cuenta propia (Reglamento) for self-employed activity. Alta in RETA is required in both cases.

Information material, not an individual legal opinion. Conditions apply to each specific situation and may change.
In brief
  • A freelancer on a DNV is also an autónomo: under UGE rules, they register (alta) in RETA after receiving the permit. The choice is between two residence permits [4].
  • DNV (Ley 14/2013): remote work for companies outside Spain, Spanish clients up to 20%, a UGE decision within 20 days, a permit for up to 3 years [1].
  • Cuenta propia (RD 1155/2024): independent activity in Spain, applied for through a visa, a decision within 3 months with silence meaning refusal, and for the first year a 1-year permit limited to one region and sector [2].
  • Renewal: the DNV for 2 years [1], cuenta propia for 4 years if the activity is proven [2].
  • A permit under Ley 14/2013 can be swapped for another at any time if you meet the conditions of the new one [3].

Digital nomad vs autónomo in Spain: two questions people confuse

The word “autónomo” means two different things in Spain. The first is the Seguridad Social scheme for the self-employed, RETA (Régimen Especial de Trabajadores Autónomos). The second is a basis for a residence permit, residencia temporal y trabajo por cuenta propia. A freelancer on a DNV also becomes an autónomo in the first sense: under UGE rules, a self-employed person registers (alta) in RETA after receiving the permit and before starting work in Spain [4]. So the choice “nomad or autónomo” is really a choice between two residence permits: one under Ley 14/2013 (teletrabajo) and one under the Reglamento (RD 1155/2024, cuenta propia).

When the digital nomad visa fits

  • All or almost all of your clients are outside Spain, and the Spanish share does not exceed 20%. How the share is calculated: the 20% rule.
  • You can prove income at or above the threshold through contracts with foreign companies covering three months [4]. The calculation: income for the DNV.
  • You have a degree or at least three years of experience.
  • You need a quick application from Spain and a 20-day decision time [1].
  • You want a three-year permit straight away, with no tie to a region or sector [1].

When cuenta propia fits

  • Most of your work is for clients in Spain: for the DNV, the Spanish share is limited [1].
  • You are building a business in Spain and can show a project, sufficient investment and an impact on employment, including self-employment [2].
  • Your profession is regulated and requires colegiación [2].
  • Your income is not enough for the DNV threshold: article 84 sets no percentage of the SMI, but there are other requirements [2].

The price of this choice: applying through a consulate, three months of waiting with silence meaning refusal, and a first year limited to one region and sector [2]. More on this basis itself: cuenta propia in Spain. The step-by-step procedure for the DNV is in the DNV route card, and for cuenta propia work residence in the “Work” route card.

Three profiles: how people choose in practice

The profiles are hypothetical and illustrate the logic.

  • All clients abroad, income above the threshold. The DNV fits here: its conditions are written for exactly this case, the decision time is short, and the permit is for three years straight away [1].
  • The main client is in Spain. For the DNV, the Spanish share is no more than 20% [1], so you need to change your client structure or look at cuenta propia [2].
  • A mixed set-up: about 70% abroad, 30% in Spain. The Spanish share is above the DNV limit. The options are to cut the Spanish part to 20% or to choose cuenta propia. Which is better depends on your contracts and on how you plan to grow.

What evidence is needed in each case

For the DNV, UGE lists a set of documents: an agreement or contract with a foreign company for at least three months, a register extract for the company (activity for at least a year), a letter from the company, three months of income with a bank certificate in the applicant’s name, social security documents, insurance, a criminal record certificate, and a degree or proof of experience [4]. In detail: Digital Nomad requirements.

For cuenta propia, article 84 of the Reglamento lists six requirements: meeting the conditions the law sets for nationals to start such an activity; qualification or proven experience and, where required, colegiación; sufficient investment and an impact on employment, including self-employment; no current undertaking not to return to Spain; no threat to public order, security or health; and payment of the fee [2].

Family: what changes

For the DNV, UGE allows family members to apply together with you or later, and their permits give them the right to work without restrictions [3]. The income threshold increases by 75% of the SMI for the first family member and 25% for each additional one: €1,068 and €356 a month [4]. For cuenta propia, family rules follow the general scheme; we do not cover them in this article. Family cases on the DNV: Digital Nomad family.

Can you switch from one permit to the other?

UGE states that once you have a teletrabajo permit, you can swap it at any time for another permit under Ley 14/2013 if you meet and keep meeting its requirements. For the general scheme, Título XI of Real Decreto 1155/2024 on changes of status applies [3]. Whether to move from the DNV to cuenta propia depends on whether you meet the conditions of the new authorisation at the time you apply.

Contributions and taxes

A freelancer on either the DNV or cuenta propia pays RETA contributions. The amount depends on net monthly income (rendimientos netos): the general and reduced tables are approved every year, and in 2026 the base can be changed every two months, no more than six times a year [5]. The Seguridad Social page describes a reduced rate of €80 a month for the first twelve months, for those who were not autónomos in the previous two years, for the period 2023-2025; we have not confirmed whether it applies in 2026 [5]. Tax residence and taxes: digital nomad taxes; the Beckham law: Beckham regime.

Common mistakes when choosing

  • Thinking you can skip registering as an autónomo on a DNV. A freelancer needs an alta in RETA [4].
  • Counting on silencio positivo with cuenta propia: there, silence means refusal [2].
  • Taking on a Spanish job after getting the DNV without keeping track of the 20%.
  • Comparing only the timeframe, 20 days against three months, and forgetting the region and sector restriction under cuenta propia [2].
  • Choosing cuenta propia without a project and an investment calculation [2].
  • Choosing the DNV when your income is below the threshold and you have nothing to cover the gap [4].

Frequently asked questions

Which is better for a freelancer: the DNV or autónomo?
It depends on your clients and income. The DNV suits you if your clients are abroad and your income is at or above the threshold, with a Spanish share of up to 20%. Cuenta propia is needed if most of your work is in Spain and you have a project with an investment calculation. The two permits differ in conditions, timeframes and risks, so there is no general answer. [1][2]
Do you need to register as an autónomo if you have a DNV?
Yes, a freelancer on a DNV needs an alta in RETA after receiving the permit and before starting work in Spain. For an autónomo, “importing” rights under an agreement with another country is not allowed, and if the alta is not done, the permit may be terminated. The arrangement is different for an employee. [3][4]
How many Spanish clients can you have on the DNV and on cuenta propia?
On the DNV, work for companies in Spain can make up to 20% of all your professional activity. For cuenta propia, articles 82 - 87 of the Reglamento set no 20% limit, but there are requirements for the project, investment and qualification, and in the first year the permit is tied to one region and sector. [1][2]
Which is faster: the DNV or cuenta propia?
UGE’s decision time for the DNV is twenty days from electronic submission, and silence means approval. For cuenta propia it is three months, silence counts as refusal, and you apply through a consulate. Actual timeframes depend on the case; consular visa timeframes are separate, and there is no official data on them. [1][2]
Can you switch from the DNV to cuenta propia?
UGE allows a swap to another permit at any time if you meet the conditions of the new one; for the general scheme, Título XI of the Reglamento applies. You must prove the cuenta propia requirements at the time you apply, including the project and investment. How this would work in your case should be settled before you give up the DNV. [3]
How much does a freelancer pay into RETA?
The contribution depends on net monthly income according to tables approved every year; in 2026 the base can be changed every two months. The Seguridad Social page describes a reduced rate of €80 for the first 12 months for 2023-2025; we have not confirmed it for 2026. [5]
