Criminal record certificate from Russia for Spanish residency: apostille

A Russian criminal record certificate is ordered via Gosuslugi from the GIAC of the Interior Ministry (MVD), with a standard processing time of up to 30 calendar days; the MVD adds the apostille, and a sworn translation is then required. You need one for each country you lived in over the last two years, plus a declaration covering five years.

Information material, not an individual legal opinion. Conditions apply to each specific situation and may change.
In brief
  • What the law requires: a certificate from the country or countries where you have lived for the last 2 years, and a declaration (declaración responsable) that you have had no criminal convictions in the last 5 years; the legal basis is Article 62.3 c of Ley 14/2013 [1].
  • Russia: the Spanish consulate in Moscow requires a Hague Convention apostille on a certificate issued in Russia, plus a translation into Spanish [2][4].
  • Gosuslugi: the service is provided by the GIAC of the Russian Ministry of Internal Affairs (MVD) and the regional MVD bodies; the official processing time is up to 30 calendar days from registration of the application [5].
  • The apostille on the certificate is issued by the Russian MVD, not the Ministry of Justice: this is stated in the list of authorities published by the Ministry of Justice with reference to Government Resolution No. 479 [6].
  • Neither the law nor the UGE checklist states how long the certificate is valid. Order it so that it is recent on the day you apply, and check the consulate’s requirement in advance [1][3].

Which criminal record certificate you need for a residence permit in Spain

For applicants under Ley 14/2013, including the digital nomad residence permit, the basis is Article 62.3 c: no criminal record in Spain or in the countries where you have lived in the last two years, plus a declaration that you have had no criminal convictions in the last five years [1]. The UGE checklist describes the certificate as follows: “certificado de antecedentes penales del país o países donde haya residido durante los últimos dos años”; the declaration is a separate document signed by you [3].

The criterion is where you have lived, not your nationality. If you have lived in Georgia, Turkey or Armenia for the last two years, you need a certificate from there, and you may not need a Russian one at all. If you have lived in two countries, you will need both. Draw up a timeline of countries and dates of residence before ordering anything: the lawyer will use it to work out the list.

You do not need the certificate if you already hold a permit or stay in Spain for more than 6 months and submitted it for that permit [3]. For a visa through a consulate, the certificate is submitted as an original and a copy, translated and legalised [2].

How to order the certificate through Gosuslugi and the MVD's GIAC

The service “Obtaining a certificate of the existence (absence) of a criminal record and (or) criminal prosecution” is provided by the Russian MVD and its regional bodies; the result is either a certificate or a refusal to issue one [5]. The official processing time is no more than 30 calendar days from the day the application is registered [5]. The document list on the service page: an application, a copy of the completed pages of an identity document and, for a representative, a copy of the letter of authority [5].

For people who have already left, this option matters: a letter of authority is on the list of acceptable documents, and an authorised person can collect the certificate [5]. How to execute a letter of authority from abroad, and whether the information centre accepts it, needs to be checked on the service page and with the centre itself. We could not open the mvd.ru pages from Spain, so we have not checked the format of the certificate (paper or electronic with a signature) or the exact procedure.

Apostille on the certificate: who issues it and what to check before ordering

The apostille (the 1961 Hague Convention stamp that certifies the authenticity of a signature and seal) on a criminal record certificate is issued by the Russian MVD. The Ministry of Justice publishes a list of competent authorities: the MVD apostilles certificates on the existence or absence of a criminal record issued by internal affairs bodies [6]. In the same list, the Ministry of Justice is responsible for other documents. The consulate in Moscow expressly requires an apostille on certificates issued in Russia, Belarus, Armenia and Uzbekistan [2].

A practical question: can an electronic certificate be apostilled? According to the descriptions from regional MVD offices that we saw in search results, the apostille is placed on a paper original issued by the information centre itself, not on an electronic certificate. We could not open the pages themselves, so check this before ordering: if you need an apostille, order a paper copy specifically. The processing time and the fee for the apostille are given on your information centre’s page; we do not quote them.

If you have lived in Spain, the Spanish certificate is ordered from the Ministry of Justice: the procedure is described in the article certificado de antecedentes penales. For documents from other countries, the apostille is issued by an authority of the issuing country; the list of countries that are party to the Convention is on the Spanish Ministry of Foreign Affairs website [7].

Translation and legalisation of the translation

Public documents that are not in Spanish are submitted with a translation by a sworn translator (traductor-intérprete jurado) appointed by the Spanish Ministry of Foreign Affairs [3][4]. Such a translation is valid in Spain without further legalisation [7]. If the translation is made abroad, it must be legalised as well: a translation by the Spanish consulate goes through the Sección de Legalizaciones, and a translation by your country’s consulate in Spain must carry an apostille or legalisation [3][4].

The order is: first the certificate, then the apostille, then a translation that includes the apostille. If you translate too early, the apostille added later may require more work from the translator; agree this with them in advance. Filing with the UGE or the consulateofficial sources do not state how long the certificate is validUGE [3]

Neither the law nor the UGE checklist states how long the certificate is valid; the consulate in Moscow does not state it either [1][2][3]. This does not mean there is no limit: some consulates set their own. Order it so that the certificate is recent on the day you apply and does not go stale while waiting for translation, and check the requirement of the consulate or the UGE inspector before ordering. A recent apostille does not by itself make the content any more current.

Common mistakes

  • Ordering the certificate by nationality rather than by the countries of residence over the last 2 years [1].
  • Getting an electronic certificate when an apostille is needed: check the format before ordering.
  • Going to the Ministry of Justice for the apostille: on MVD certificates, the MVD issues it [6].
  • Translating the document before the apostille, or with a translator not appointed by MAEC [3][4][7].
  • Not attaching the declaration of no criminal convictions in the last 5 years: it is a separate document signed by you [1][3].
  • A certificate with an entry: do not remove a page or alter the document; this is a question for a lawyer. Criminal record information is special category data, so share it only with the people handling your case. General overview: criminal record certificate for a residence permit.

How we can help

The ReloVictory team in Barcelona draws up a timeline of your countries of residence, works out the list of certificates and checks that the “certificate, apostille, translation” chain fits the deadlines. The applicant orders the certificate in Russia personally through their own account or through a representative. The legal side is handled by the team’s lawyer. Book: consultation. Service page: documents and legalisation. General list: document checklist for a residence permit. For the DNV, document preparation is described step by step in the DNV route card, and a general overview is on the page residence permit in Barcelona.

Frequently asked questions

How do I get a Russian criminal record certificate for a Spanish residence permit?
Apply through Gosuslugi to the Russian MVD (the GIAC or a regional information centre): the official processing time is up to 30 calendar days [5]. Then get an apostille from the MVD [6] and have the document translated by a sworn translator [3][4]. The Spanish consulate in Moscow requires an apostille on certificates issued in Russia [2].
Who apostilles a criminal record certificate in Russia?
The Russian MVD: according to the list of authorities published by the Ministry of Justice with reference to Government Resolution No. 479, the apostille on criminal record certificates is issued by the MVD, not the Ministry of Justice [6]. The Spanish consulate in Moscow requires an apostille on certificates issued in Russia [2]. Check which certificate format is suitable before ordering.
Does the criminal record certificate need to be translated into Spanish?
Yes. A document that is not in Spanish is submitted with a translation by a sworn translator appointed by the Spanish Ministry of Foreign Affairs [3][4]. Such a translation is valid in Spain without further legalisation [7]. If the translation is done differently or abroad, it must be legalised as well.
How long is a criminal record certificate valid for a Spanish residence permit?
Neither the law nor the UGE checklist states a validity period, and neither does the consulate in Moscow [1][2][3]. A consulate or an inspector may have their own requirement, so order the certificate for the time of your application and check this in writing in advance. A recent apostille does not extend the validity of the certificate’s content.
Do I need a certificate if I do not live in Russia?
You need a certificate from the country where you have lived for the last 2 years, not from your country of nationality [1][3]. If you have lived in several countries, you will need certificates from each. You also submit a declaration that you have had no criminal convictions in the last 5 years. Draw up a timeline of your residence before ordering.
Can I order the certificate through a representative?
The document list for the service on Gosuslugi provides for a letter of authority for a representative. Whether the information centre accepts a letter of authority executed abroad, and how it should be certified, check on the service page and with the centre. [5]
What should I do if the certificate shows an entry?
Do not alter the document or remove a page. The nature of the entry and the applicable rule need to be analysed, and the details depend on the case: show the certificate to a lawyer before applying. The general limits are described in our article on the certificate for a residence permit. [1][3]
