Divorce in Spain and a foreign spouse's residence permit: what to check

What happens to a residence permit after divorce depends on the grounds on which it was issued and how long the marriage lasted. This article does not assess your case: it shows what to check before filing for divorce and the deadlines that apply.

Information material, not an individual legal opinion. Conditions apply to each specific situation and may change.
In brief
  • First, identify the basis of your residence permit: if it derives from your spouse (reagrupación, spouse of a Spanish or EU citizen), divorce may affect it; if it is your own (work, a DNV you applied for yourself, studies), its basis does not change [1][2].
  • To keep your residence after divorce, the Reglamento names, among other things, a marriage of at least three years, one of them in Spain, or custody of the children you have in common, or visiting rights with a child in Spain (articles 69.2.a and 99.4) [1].
  • The six-month deadline: the application for an independent permit is filed within six months of the date of notification that the divorce, annulment or separation claim has been admitted [1][4].
  • For an EU citizen, Real Decreto 240/2007 applies: the right of residence can be kept on divorce with three years of marriage (one year in Spain), custody, visiting rights with a child or particularly difficult circumstances [2].
  • If there was violence in the marriage, the length of the marriage does not matter, but documents are required: a court protection order, a report from the public prosecutor or another official act [1].

Divorce in Spain and the foreign spouse's residence permit: what your status depends on

Divorce changes the status only of those whose residence permit rests on the marriage. Check which row of the table applies to you [1][2][3]:

Basis of your residence permitWhat to check after divorceRule
Reagrupación: spouse is a foreign residentThree years of marriage and one year living together in Spain, or custody of children in common; application within six monthsArticle 69.2.a Reglamento
Spouse is a Spanish citizen (article 94.1.a)Three years of marriage with one year in Spain, custody or visiting rights with a child; report the changeArticle 99.4
Spouse is a citizen of another EU countryThree years of marriage (one year in Spain), custody, difficult circumstances or visiting rightsReal Decreto 240/2007, article 9.4
Your own residence permit: work, studies, no lucrativa, a DNV you applied for yourselfThe basis does not change, but check the family partAccording to your basis

The law sets the general rule: a spouse who obtained residence for family reasons keeps it after the marriage breaks down, and the required period of living together is set by the regulation (article 16.3 Ley Orgánica 4/2000) [3]. How marriage and partnership are formalised: marriage in Spain to a foreign national, pareja de hecho in Barcelona.

How to check your status: five steps

  1. Open your resolución and TIE: on what basis your residence permit was issued and until what date (family of a resident, family of a Spanish citizen, family of an EU citizen, other).
  2. Establish your spouse’s nationality and status as of today: Spanish citizen, EU citizen, foreign national with a residence permit.
  3. Write down the dates: the wedding, the start of living together in Spain (historical padrón certificate), the filing of the claim or agreement, the expiry of your card.
  4. List the children: those you have in common, their ages, where they live, who has custody, whether there is a decision on visiting rights.
  5. Compare the deadlines with the table below and talk to a lawyer before filing for divorce: some wording in the convenio regulador or in the court decision changes your position regarding the residence permit [1].

Deadlines: what to work out first

WhatDeadlineLegal basis
Notify the authorities of a divorce, annulment of the marriage or cancellation of the partnership registration6 months from the eventArticle 99.4, SEM instruction 2/2025 [1][4]
File the application for an independent permit on divorce6 months from the date of notification that the claim was admitted or of the decision to cancel the partnership registrationArticles 69.2.a and 99.4 [1]
Report a change of address, nationality or marital status2 months (general procedure); for the family of a Spanish citizen the instruction sets a single deadline of 6 monthsArticle 98.2, SEM instruction 2/2025 [1][4]
Card renewal2 months before expiry and 3 months afterArticles 71.1 and 95.4 [1]

If the six months have been missed, SEM instruction 2/2025 leaves the option of requesting a modification of the permit under article 191 [4]. The conditions and the deadline are checked separately in that case, so missing the deadline is not necessarily the end, but it is not routine either. If your residence permit is based on being family of a Spanish citizen, see the details of that regime in the article residence permit for a relative of a Spanish citizen.

Children and custody: what they change for your status

Custody of children in common is in itself named in articles 69.2.a and 99.4.b and in Real Decreto 240/2007 as a ground for keeping residence, and for a reunited spouse article 69.2.a requires a shorter period of living together where there is custody [1][2]. Visiting rights with a minor child living in Spain, under an agreement or decision in force, are also named as a ground for the family of a Spanish or EU citizen [1][2]. If the Spanish citizen stops living in the country, this does not take away the right of residence of the children and of the parent who has custody of them, as long as the children are studying in Spain (article 99.3) [1].

Catalan law requires the agreement on the children to include a plan de parentalidad: where the child lives, who is responsible for what, how contact takes place [7]. We do not assess how specific wording will affect the residence permit: that is a question for the lawyer handling the divorce.

How divorce works: court, notary, Catalonia

In Spain a divorce is granted by a court decision on the application of one or both spouses (article 86 Código Civil) [5]. By mutual consent the spouses can divorce without going to court, before a letrado de la Administración de Justicia or a notary, but only if there are no minor children or children with court-ordered support measures (articles 82 and 87) [5].

In Catalonia, where there are children in common, the convenio must be approved by a judge; if there are no children, it can be signed before a letrado or a notary, but always with a lawyer and in person; the convenio for children includes the plan de parentalidad and maintenance [7]. Catalan law allows mediation before the claim and during the proceedings [7]. The divorce takes effect when the decision becomes final or when the agreement is signed before the notary, and with respect to third parties from its registration in the Registro Civil [5][6].

Which court and which law apply when the spouses have different nationalities is determined by European Union rules and Spanish private international law (article 107.2 Código Civil) [5]. For a couple from different countries this is a separate question for a lawyer.

If there was violence in the marriage

For victims, the Reglamento does not require any minimum period of marriage or living together: independent residence is possible in cases of gender-based violence, sexual violence, domestic violence, human trafficking or abandonment of the family (article 69.2.b, article 99.5) [1]. A document is required: a court protection order, a police or public prosecutor’s report confirming signs of violence, or a document under special legislation. The application deadline is six months from the date the documents are served [1]. A similar condition exists for the family of an EU citizen in Real Decreto 240/2007 [2]. If you are in danger, contact the police, the court or victim support services. This comes before any status questions.

Common mistakes

  • Waiting for the case to end. The six months run from the notification that the claim was admitted, not from the decision [1].
  • Thinking that separation without divorce changes nothing. Article 98.3 names the loss of family life as a ground for withdrawing the permit of the family of a Spanish citizen, and under 94.1.a a marriage with a divorce decision does not qualify [1].
  • Not reporting the divorce on time. For the family of a Spanish citizen, the deadline is six months from the event [4].
  • Mixing up regimes. The spouse of a Spanish citizen and the spouse of an EU citizen fall under different rules [1][2].
  • Not counting the length of the marriage and the year in Spain. Without evidence (padrón, rental contract) the condition is hard to meet.
  • Not renewing the card within the window. Renewal is possible 2 months before and 3 after [1].

Citizenship and divorce

If you were working towards Spanish citizenship as the spouse of a Spanish citizen with the reduced period of one year (article 22.2.d Código Civil), the basis is a marriage without separation: after divorce or separation it no longer exists [5]. The general citizenship periods are covered in the article how many years you need to live in Spain for citizenship.

When you need an individual review and how we help

A review is needed in almost every case where the residence permit is tied to the marriage: deadlines are short, the consequences are serious, and the answer depends on documents and facts. The ReloVictory team helps check your status under the Reglamento and the authorities’ instructions, put together the timeline and documents, and prepare the application together with a lawyer. The divorce proceedings themselves are handled by a family lawyer; the residence permit status is checked separately. We are not responsible for how long the authorities take to respond. Booking: consultation, section family. The family route card shows which regimes are available to families, and the general procedure is described in the section residence permit in Barcelona.

Frequently asked questions

Will I lose my residence permit after a divorce in Spain?
It depends on the basis of the residence permit and the length of the marriage. If the permit was issued to you as a family member, the law keeps it when certain conditions are met, for example three years of marriage with one year in Spain or custody of the children. An individual review is needed. [1][3]
How long must the marriage have lasted to keep the residence permit?
Under articles 69.2.a and 99.4 of the Reglamento, at least three years before the proceedings began, one of them in Spain. Where there is custody of children in common, the period of living together can be shorter for a reunited spouse. A similar rule applies in the EU regime. [1][2]
When should you apply for independent residence?
Within six months of the date of notification that the annulment, divorce or separation claim was admitted, or of the decision to cancel the partnership registration. After six months you can still request a modification of the permit under article 191; check the conditions. [1][4]
Do you need to report the divorce to the immigration authorities?
For the family of a Spanish citizen, yes: the divorce must be reported within six months; SEM instruction 2/2025 sets a single deadline. For other regimes, check the procedure with a lawyer before filing. [1][4]
What happens to the residence permit if the children stay with me?
Custody of children in common is named in the Reglamento and in Real Decreto 240/2007 as a ground for keeping residence, and for a reunited spouse a shorter period of living together is required where there is custody. The conditions depend on the regime and the facts. [1][2]
Can you divorce without going to court?
Yes, by mutual consent before a letrado de la Administración de Justicia or a notary, if there are no minor children or children with court-ordered support. With such children the convenio is approved by the court. In Catalonia a lawyer is required. [5][7]
What should you do if there was violence in the marriage?
For victims, the Reglamento does not require a minimum period of marriage: an independent permit is possible with a court protection order or a report from the public prosecutor or the police. The application deadline is six months. First seek protection from the police or the court. [1]
