Pareja de hecho in Catalonia: registering in Barcelona and residency

In Catalonia a pareja de hecho is called a pareja estable and arises after two years of living together, with a child in common or by notarial deed; registration with the Generalitat register is voluntary. The status does not in itself grant residence: the immigration procedure requires registration in a public register or 12 months of proven cohabitation.

Information material, not an individual legal opinion. Conditions apply to each specific situation and may change.
In brief
  • Catalan law and the immigration regulation do not match: a pareja estable arises after two years of living together, with a shared child or through a notarial document (article 234-1 of the Código civil de Cataluña), whereas a residence permit requires an entry in a public register or 12 months of proven cohabitation [1][2].
  • Registration in the Registre de parelles estables de Catalunya is voluntary and does not create the couple; both partners must consent. You can apply online, in person by appointment or by video call; the inscripció is free, the certificat is paid [5].
  • The application route depends on the partner’s nationality and status: resident, Spanish citizen, citizen of another EU state or DNV holder. A single document from Catalonia is not enough for every route [2][3][4].
  • Marriage, a registered couple and an unregistered stable couple are treated as mutually incompatible for the purposes of the regulation (articles 66.1.b and 94.1) [2].
  • For a Catalan pareja estable you cannot be married without being de facto separated, and you cannot be in a couple with a third person (article 234-2). Rights to compensation and maintenance after a break-up expire after one year (article 234-13) [1].
  • A break-up affects your status: if you hold a residence permit through the couple, you must report it within six months, and the right to an independent permit depends on how long the couple lasted and how long you have been in Spain [2].

Pareja de hecho in Catalonia and residence: two laws and two goals

In Catalonia an unmarried couple is legally called a pareja estable. Two people living in a union similar to marriage are a couple in one of three cases: they have lived together for more than two consecutive years, they have a shared child born while living together, or they have formalised the relationship in an escritura pública (article 234-1) [1]. While you live together, your relationship is governed by your own agreements: the law leaves this to the couple [1].

The immigration regulation (Real Decreto 1155/2024) sets its own criteria. An unmarried couple needs one of two things: an entry in a public register of an EU or EEA state or Switzerland that has not been cancelled, or a stable couple that is “debidamente probada”, meaning proven cohabitation similar to marriage for at least 12 consecutive months, in Spain or abroad. With a shared child, no minimum period is required [2]. So a couple who have lived together for three months without a child are not a couple in Catalonia, while a couple of 14 months without registration may qualify for the immigration procedure if the cohabitation is proven. Keep these two questions separate.

We have found no confirmation that an entry in the Generalitat’s parelles estables register counts as the “public register” referred to in the regulation.

How to register a pareja de hecho in Barcelona: step by step

Registration is not compulsory for a pareja estable: the couple arises on one of the three grounds in article 234-1, so “formalising” it means preparing evidence, signing a notarial document and, if you wish, entering the couple in the register [1][5].

  1. Check the impediments. The following cannot form a couple: minors who are not emancipated, direct relatives and collateral relatives up to the second degree, people who are married without being de facto separated, and anyone living in a couple with a third person (article 234-2) [1].
  2. Choose the ground. Two years of living together are proven by your registration history at the same address; in Barcelona this is the certificate of cohabitation, see how to get a registration certificate. A shared child born while you live together creates the couple from birth. An escritura pública signed before a notary creates the status immediately, without waiting two years, and can include pactos on the consequences of a break-up [1]. Notary fees vary; we have not checked them.
  3. Gather the documents for registration. The Generalitat lists both partners’ identity documents, a full birth certificate issued no earlier than six months before the application (for dual nationals with Spanish nationality, the Spanish one), a historical padrón certificate showing joint registration and, for a couple based on a shared child, the child’s birth certificate or libro de familia [5].
  4. Apply to the Registre de parelles estables de Catalunya. The register is kept by the Departament de Justícia; it was created by Decret llei 3/2015 and its procedure was approved by Ordre JUS/44/2017. You can apply online, in person by appointment or by video call; online applications require digital certificates, and each partner completes, signs and sends the form separately [5].
  5. Get the certificate. If you do not object to automatic verification, the Generalitat checks the data itself and exempts you from providing the identity document, the padrón certificate and the child’s birth certificate. The inscripció is free; the certificat costs €11.75 according to the Generalitat’s page [5].

The Generalitat’s page does not say what the register accepts from foreign nationals (apostille and translation of the birth certificate), so it is best to prepare documents with a margin: apostille on Russian documents. According to the Departament de Justícia, an entry in the municipal register of the place of residence (where one exists) is admissible evidence of the couple [6]; check locally whether the Ajuntament of Barcelona currently accepts such entries.

Which application regime applies to the couple

Whether the Catalan status matches the immigration criterion depends on the route.

Who the partner isRuleWhat counts as a coupleSpecifics
Foreign residentRD 1155/2024, article 66.1.b [2]Entry in a public EU register or 12 months of proven cohabitation; no minimum period with a shared child [2]The resident applies after one year of residence; requires funds of 150% of IPREM for two, housing and insurance [2][7]
Spanish citizenRD 1155/2024, article 94.1.b and c [2]The same two options; condition “convivan” [2][8]Free of charge, no income requirement, permit for 5 years [2][8]
Citizen of another EU stateRD 240/2007, articles 2.b and 2 bis [3]A couple registered in a public register; an unregistered couple is assessed separately: one year of living together or a shared child [3]Familiar de ciudadano de la Unión card; more about the card [3]
Holder of a permit under Ley 14/2013 (DNV)Ley 14/2013, article 62.4 [4]The law refers to a “person with an analogous marital relationship”: there is no definition [4]Filed together with the main applicant’s application or afterwards [4]

The law gives no definition of a couple for the DNV, so it is best to gather evidence of cohabitation according to the strictest of the options described above. What to prove: Catalan partnership versus partnership for immigration purposes

CriterionCatalan lawImmigration regulation
Period of cohabitationMore than two consecutive years, unless there is a child or an escritura [1]At least 12 consecutive months; not needed with a shared child [2]
Where you livedNot regulated by article 234-1In Spain or abroad [2]
AgeMinors who are not emancipated cannot form a couple [1]Partner over 18 [2]
Marriage or another coupleYou cannot be married without being de facto separated or be in a couple with a third person [1]Marriage, a registered couple and a stable couple are incompatible [2]
KinshipYou cannot be direct relatives or collateral relatives up to the second degree [1]The regulation does not specify this separately; the question is decided under personal law

What to put in the file. A historical padrón certificate of registration at the same address, a rental or mortgage contract in both names, joint accounts, utility bills, correspondence and tickets, birth certificates of shared children. In Barcelona the certificate of cohabitation is called the volant de convivència; see how to get a registration certificate. Registration at the same address does not by itself prove the couple: it is one piece of evidence, not a substitute for the rest. If you lived together but were registered at different padrón addresses, explain this in advance and with documents, not just in words.

For the family of a Spanish citizen, Hoja 18 says “siempre que convivan”, that is, provided they live together, and instruction SEM 2/2025 specifies that separate proof of cohabitation is required only for a stable couple without shared children [8].

Do not declare periods that did not happen. A fictitious or merely formal couple harms both the Catalan status and the immigration application: the regulation requires that the union was not entered into to circumvent the law [2].

Order of applying for residence as a partner: what comes first and what next

  1. Determine the application route according to the partner’s nationality and status. Until you know the route, you cannot tell which family documents you need [2][3][4].
  2. Check both criteria: the Catalan one (whether you need pareja estable status in Catalonia for other purposes) and the immigration one (whether there is an entry in a public register or 12 months of proven cohabitation).
  3. Put together a timeline of your life together and the documents. If the period is too short, the options are registering the couple, a notarial document or the birth of a child: which of these the authority accepts for a residence permit depends on the route, and we have found no confirmation for the Catalan notarial document.
  4. Prepare your foreign documents: birth certificate, document on marital status, translation and apostille [7][8].
  5. Apply under your route. For the procedure and deadlines, see the articles family reunification in Spain and residence permit for a relative of a Spanish citizen.
  6. Keep track of changes. Changes of address, marital status and the couple’s registration must be reported: for the family of a Spanish citizen, within two months (article 98.2) [2].

Separation: how to end a pareja estable and what happens to the residence permit

In Catalonia a pareja estable ends when the cohabitation ends, on death, if one of the partners marries, by notarial agreement or at the will of one partner with reliable notice to the other (article 234-4). Rights to compensation for work done for the household and to maintenance expire after one year and must be claimed in the same proceedings in which the other consequences are determined (article 234-13) [1].

The register entry is cancelled with a document showing that the couple has ended: for example, a collective registration certificate showing that the other partner no longer lives at the address, a marriage or death certificate, a notarial deed or a letter with proof of content and receipt [5]. If there are children after the break-up, the home can be assigned to the partner they live with, and maintenance in the form of a pension is limited to three years, except where shared children are being cared for [1].

For a residence permit, immigration deadlines apply after a break-up. A partner of a Spanish citizen can obtain an independent permit if the couple lasted at least three years, one of them in Spain, or if they have custody of shared children or visiting rights. The application must be filed within six months of the date the cohabitation ended or of the decision to cancel the entry (article 99.4); for reagrupación the conditions are similar (article 69.2.a) [2]. In detail: divorce and the spouse’s residence permit. Which is better, marriage or pareja de hecho: marriage or pareja de hecho for a residence permit.

Common mistakes

  • Believing that an entry in the Catalan register creates the couple or grants a residence permit. An entry is not among the grounds in article 234-1, the register is voluntary, and the residence permit is decided through a separate procedure [1][2][5].
  • Confusing two years (Catalonia) with 12 months (the regulation) [1][2].
  • Applying under the EU route when the Spanish citizen’s family route applies, or the other way round. The choice depends on the partner’s nationality and situation.
  • Registering the couple while one partner is married without being de facto separated [1].
  • Not gathering evidence for the whole period: padrón for only one year, contracts in another person’s name [2].
  • Forgetting to check with the Ajuntament whether it accepts entries of couples in the municipal register, where one exists [6].
  • Not signing pactos: without them, everything after a break-up is decided under the general rules [1].
  • Missing the six months after a break-up or the one year for rights under Catalan law [1][2].

When you need an individual review

A review is needed if one partner has not yet dissolved a previous marriage, the partners have different nationalities, part of your life together was abroad, there is no joint registration, documents from CIS countries have spelling discrepancies, the couple has children from previous relationships, or you are planning a notarial document for the sake of a residence permit. The answer depends on the facts of your case, and there is no universal scheme.

Frequently asked questions

Does a pareja de hecho in Catalonia give you the right to a residence permit?
No, not by itself. The immigration procedure requires an entry in a public register or 12 months of proven cohabitation (no minimum period with a shared child), and the applicable route depends on the partner’s status [2].
How do you formalise a pareja de hecho in Barcelona?
The couple arises by itself after two years of living together, with the birth of a shared child, or immediately through an escritura pública before a notary. After that, if you wish, the couple is entered in the Registre de parelles estables de Catalunya: online, in person by appointment or by video call, with the consent of both. [1][5]
Do you need to register the couple in the Generalitat’s register?
Catalan law does not require it: the couple arises under article 234-1. Registration is voluntary, requires both partners’ consent, and the inscripció is free. It makes proof easier, but we have not confirmed whether the authority will treat it as the regulation’s “public register” for a residence permit. [1][2][5]
Which documents are needed to enter the couple in the register?
Both partners’ identity documents, a full birth certificate no older than six months, a historical padrón certificate showing joint registration and, for a couple based on a shared child, the child’s birth certificate or libro de familia. The Generalitat can verify some of the data itself. [5]
How long do you need to live together for a residence permit as a couple?
Under the regulation, at least 12 consecutive months, in Spain or abroad, if the couple is not registered and has no shared child. For a pareja estable under Catalan law, more than two years [1][2].
Can the partner of a foreign resident get a residence permit as a couple?
Yes, through reagrupación under article 66.1.b, if the resident has lived in Spain for one year, is applying for a renewal for another year and proves income, housing and insurance [2][7].
How do you include a partner in a DNV application?
The law allows an application for a “person with an analogous marital relationship” at the same time as the main applicant’s application or afterwards (article 62.4). The law does not define a couple; check the document list with the UGE [4].
What happens to the residence permit if the couple splits up?
You must report the break-up within six months. You can keep the right if the couple lasted at least three years (one of them in Spain), or if you have custody of shared children or visiting rights. The application is filed within six months [2].
