- CIRBE (Central de Información de Riesgos) is the Bank of Spain’s database of loans, credit and guarantees. It is not a register of defaulters, nor is it described as a credit rating [1].
- You can get a report on yourself from CIRBE free of charge. Institutions see aggregated data on people whose accumulated risk exceeds €1,000, and only the customer can see the detailed report [1].
- ASNEF and similar registers hold information on non-payment. A debt is entered if it exists, is overdue and is not disputed, and the creditor has warned you in the contract or when demanding payment. The data is kept while the debt remains unpaid, for no longer than five years from the payment due date [3][4].
- When you apply for a mortgage, the bank requests CIRBE and the non-payment registers (RAI, ASNEF) and analyses your income, expenses and commitments [5][6].
- The official sources we consulted do not say how a credit history from Russia and the CIS is taken into account: assume that the bank assesses your ability to repay on the basis of income documents [6].
Credit history in Spain: what it is and what it consists of
In Spanish practice, a credit history is not a single document but three layers of information used by banks.
| Source | Who keeps it | What it contains | Who can see it |
|---|---|---|---|
| CIRBE | Banco de España | Loans, credit, guarantees, sureties [1] | Reporting institutions, when you apply; you yourself, free of charge [1] |
| Non-payment registers (ASNEF, RAI and similar) | Non-payment information systems, for example ASNEF (processed by Equifax Ibérica) [4] | Information on overdue debts [3][4] | Those who have a contractual relationship with you or have received an application for financing from you [3] |
| The bank’s internal assessment | The specific bank | Income, expenses, commitments, assets [6] | The bank, for the lending decision |
Together, this data determines the bank’s decision. The law on real estate credit expressly requires the bank to assess your ability to repay rather than rely mainly on the collateral [6].
CIRBE: what it records and how to get your report
CIRBE (Central de Información de Riesgos, also CIR) is the Bank of Spain’s database of loans and credit (direct risk) and of guarantees and sureties (indirect risk) that institutions hold with their customers. The Bank of Spain stresses that CIRBE is not a register of defaulters [1].
Data is made available to you and to institutions as follows:
- Institutions that report data to CIRBE receive aggregated information every month on people whose accumulated risk exceeds €1,000 [1].
- The aggregated report shows total amounts by type of risk, limits, credit drawn, types of guarantee and terms. It does not list each loan or the banks [1].
- The detailed report, available only to the data subject, contains each transaction, the name of the institution and more specific data, including institutions with risks below €1,000 [1].
- The data refers to the last closed monthly report and to the report from six months earlier [1].
Any individual or legal entity can get a report on themselves free of charge by applying on the Bank of Spain’s website. You cannot request data about other people [1]. An institution or a mortgage credit intermediary may request information about you only if you are asking for a transaction involving risk (for example, a loan or a mortgage) or you are listed as an obligor or guarantor [1].
If the data is wrong or incomplete, contact the institution that reported it and ask for it to be corrected or deleted. You can also file a complaint with the Bank of Spain [1].
ASNEF and debtor registers: how you get in and how to get out
ASNEF is a non-payment file processed by Equifax Ibérica. To exercise your rights (access, rectification, erasure, objection, restriction), you contact Equifax Ibérica through its website or by letter; the data protection law allows one month for a reply, which can be extended by a further two [4].
The personal data protection law (article 20 of LO 3/2018) sets out the conditions under which such records are lawful [3]:
- the data was provided by the creditor or by someone acting on its behalf;
- the debt is certain, overdue and enforceable, and you have not disputed it through administrative, judicial or arbitration proceedings;
- the creditor warned you of possible inclusion in the contract or when demanding payment;
- the system notifies you of the inclusion, and for 30 days after the notice the data is blocked so that you can exercise your rights;
- the data is kept while the debt remains unpaid, but for no longer than five years from the payment due date;
- the data may be consulted only by those who have a contractual relationship with you involving payment, or to whom you have applied for financing, deferred payment or recurring billing.
If you were refused a contract because of such a check, whoever made the query must tell you the result [3]. To have an entry removed, attach a document proving payment or showing that the debt has been formally disputed [4]. ASNEF and Equifax warn that they are not connected with websites that charge for access or promise to cancel debts without payment: do not pay intermediaries [4].
Who checks your history and when
They are checked when you apply for financing. For a mortgage, the bank assesses your income and expenses, requests CIRBE and the non-payment registers (RAI, ASNEF) and then gives its decision [5]. The law requires an assessment of employment, current and future income, assets, savings, expenses and commitments; if a refusal is based on a database query, the bank must give you a copy of the result and details of the database [6]. On the process itself: a mortgage for a non-resident in Spain.
What about credit history from Russia and the CIS
The official descriptions of CIRBE and ASNEF that we consulted contain no mechanism by which Spanish banks automatically see a credit history from another country [1][4]. CIRBE contains data from institutions reporting information in Spain. So a newcomer may have no records in Spain, and the bank relies on documents on income, employment and assets [6]. Proving income with foreign documents: Russian income certificates. Tax residence: 183 days and centre of interests.
We found no official data on whether individual banks take foreign sources into account, or how. That is the bank’s decision, not a rule of law.
How credit history is built in Spain: what can and cannot be said
We found no official way to “build up a rating”, because there is no public rating. CIRBE records actual commitments: loans, credit, guarantees. The aggregated report does not include transactions where the total risk with one institution does not exceed €1,000 [1]. Non-payment registers record arrears [3]. The Bank of Spain has no separate register of individuals’ bank accounts, and CIRBE shows credit commitments, not accounts [1][2]. What banks consider favourable or unfavourable is governed not by law but by their internal rules.
Common mistakes
Steps to take before applying for a loan or mortgage if you are new to Spain.
- Request your free CIRBE report on the Bank of Spain’s website: this shows you exactly what the bank sees about your loans [1].
- If you have debts in Spain, check whether they have been entered in a non-payment register and, if necessary, contact Equifax Ibérica with proof of payment [4].
- Gather documents on income, employment and assets: the bank assesses your ability to repay on the basis of them [6].
- Compare loan terms: fixed or variable mortgage rate.
- Treating CIRBE as a blacklist: the Bank of Spain states plainly that it is not a register of defaulters [1].
- Not requesting your own report before applying for a mortgage: it is free, and the bank will request it anyway [1][5].
- Ignoring a notice of inclusion in a register: you have 30 days, while the data is blocked, to exercise your rights [3].
- Paying intermediaries for access or for “cancelling” a debt: ASNEF and Equifax warn that they are not connected with such websites [4].
- Assuming that a debt from another country will automatically appear in a Spanish register or, conversely, disappear: there are no official descriptions of such a mechanism [1][4].
- Arguing with the bank about a refusal without asking for the result of the query: the bank is obliged to provide it [6].
When you need an individual review
A review is worth it if you have found an entry in CIRBE or a register and disagree with it, you have debts in several countries, you are a guarantor for someone else’s loan, or you are preparing a mortgage and want to understand what the bank will see. This determines where to go: to the creditor institution, to Equifax or to the Bank of Spain.
